WAIVER AND RELEASE OF LIABILITY AGREEMENT

The Figueroa Wu Family Foundation (FWFF) is committed to providing a safe atmosphere for the volunteers who seek to help us meet the needs of the community. Therefore, the FWFF requires all volunteers to read and sign the following Waiver and Release of Liability Agreement before volunteering with any of the programs within the foundation, including—but not limited to—the Pilsen Food Pantry and El Mercadito Gratis. 

I, the undersigned participant, agree to work as an unpaid volunteer for the Figueroa Wu Family Foundation. I will be responsible for scheduling and cancelling my shifts. I further understand that the FWFF relies on the information provided by me in this form in order to provide the safest possible environment for the community. I accept full responsibility for any harm or damage whatsoever caused by me.  

 

Terms & Conditions 

1. Physical requirements. I am aware that participation as a volunteer may require periods of standing, lifting and carrying up to 40 pounds, and the exercise of reasonable care to avoid injury. I am voluntarily participating in this activity with knowledge of the hazards and potential dangers involved and agree to accept any and all risks of personal injury and property damage. 

2. Health attestation. I certify that I am in good health and I do not suffer from any condition that would in any manner endanger or put at risk any staff member or volunteer of the FWFF. 

3. Hold Harmless. I agree to the fullest extent allowed by law, to protect, indemnify, and hold the FWFF, its agents, representatives, employees, volunteers, successors, and assignees, harmless from all claims or liability of every type (including court costs and legal fees) for any injury, death, or damage arising out of or relating to my services as a volunteer of the FWFF, whether or not caused or alleged to be caused in whole or in part by the negligence of the FWFF, employees, volunteers, or other organizational representatives. I further agree that I will indemnify and hold harmless all of the above individuals or entities from any loss, liability, damage, or costs which may be incurred as a result of any claim that may be made. 

4. Release of Liability. I agree and hereby acknowledge that I am aware of the risks associated with volunteering with the FWFF. I agree to wear closed-toe, non-slip shoes when I am volunteering. I hereby assume, accept, and acknowledge all responsibility for any dangers, accidents, risks, and hazards associated with said volunteer services provided by me to the FWFF and its successors and assignees, and I hereby agree to indemnify and hold the FWFF, its agents, representatives, employees, volunteers, successors, and assignees harmless from any injuries, claims, demands, causes of action, and damages, including attorney’s fees, resulting from any accident, incident, or occurrence arising out of or relating to my volunteer services provided to the FWFF and its successors and assignees, whether or not caused or alleged to be caused in whole or in part by the negligence of the FWFF, its agents, representatives, employees, volunteers, successors, and assignees. 

5. Confidentiality Agreement. I agree to hold in confidence all information I become privy to regarding clients of the Pilsen Food Pantry, Mercadito Gratis, or any other information belonging to a client seeking services from any program within the FWFF. I will not remove from the office of the Pilsen Food Pantry any electronic or written records, or copies thereof, without express permission of the Pilsen Food Pantry’s client. I accept full responsibility for maintaining the confidential nature of all records, client contacts, and information marked confidential. 

6. Stipulation for Drivers. I agree that if, as part of my volunteer efforts, I have agreed to operate a motor vehicle on behalf of the FWFF, I must have and do have a valid Illinois driver’s license that has not been suspended, revoked, or is otherwise invalid. I further agree that I am not aware of anything that will impair my ability to operate a motor vehicle. I further agree to obey all traffic laws of the State of Illinois and agree that I will not use said motor vehicle for any purposes other than that for which I volunteered on behalf of the FWFF. Upon request, I agree to provide the FWFF with a copy of my valid driver’s license. 

7. Media Release. I hereby give the FWFF permission to copyright and/or use, reuse, and/or publish, and/or republish pictures or images of me for the purpose of illustration, advertising, and promoting the agency through any medium. I hereby acknowledge that I have been given a reasonable opportunity to read the foregoing waiver, release of claims, and photo release, and that I have read it and understand its provisions. 

8. Revocation of Consent. Unless cancelled by either party, this volunteer agreement is valid for 60 months.

 

I HAVE READ THE TERMS AND CONDITIONS ABOVE. MY SIGNATURE SERVES AS A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY AS ALLOWED BY LAW. THIS AGREEMENT SHALL BE IN EFFECT FOR FIVE YEARS.

I, the undersigned participant, affirm that I am of the age of 18 years or older, and that I am freely signing this agreement. I certify that I have read this agreement, that I fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am signing it of my own free will.

I, the Parent/Guardian of the undersigned participant, affirm that I am of the age of 18 years or older, and that I am freely signing this agreement on behalf of my child. I certify that we have read this agreement, that we fully understand its content and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am signing it of my own free will.
