Guarantor Form

IMPORTANT – LIMITED GUARANTOR LIABILITY

This Guarantee is legally binding and relates specifically to the Guaranteed Tenant named in this Guarantee. By signing it, you agree to meet the obligations of the Guaranteed Tenant only to the extent expressly set out below.

Each tenant under the tenancy is required to provide their own guarantor. The tenancy agreement is joint and several, meaning the tenants are liable for each other's rent and obligations. However, this Guarantee is expressly limited to the individual share of rent attributable to the named Guaranteed Tenant only.

Notwithstanding any provision in the tenancy agreement concerning joint and several liability, the Guarantor's obligations under this Guarantee shall be strictly limited to the named Guaranteed Tenant's agreed individual share of the rent. No wider liability shall be imposed upon the Guarantor.

The Guarantor shall not be liable for the rent, arrears, debts, damages or other financial obligations attributable to any other tenant, nor shall the Guarantor be responsible for the full rent payable under the joint tenancy agreement.

The Guarantor's maximum liability shall be capped at the named Guaranteed Tenant's individual share of the rent, calculated according to the agreed division of rent between the tenants. This Guarantee shall apply only for the period during which the named Guaranteed Tenant remains responsible for their tenancy, subject to the agreed termination provisions.

The intention is that the Guarantor's liability shall cease when the named Guaranteed Tenant moves out and their tenancy obligations have lawfully ended, or when valid notice terminating those obligations takes effect. The Guarantor shall not be liable for rent accruing after that date. Any liability for unpaid rent arising before that date shall remain subject to the limits of this Guarantee.

The Landlord may take legal action to recover sums properly due under this Guarantee, but only within the limits expressly stated above and subject to applicable law.

Tenant Details

 GUARANTEE AND INDEMNITY

In consideration of the Landlord granting or continuing the joint tenancy, the Guarantor agrees to guarantee only the named Guaranteed Tenant's agreed individual share of rent, subject to the IMPORTANT – LIMITED GUARANTOR LIABILITY section.

If the Guaranteed Tenant fails to pay their agreed share of rent, the Guarantor agrees to pay the outstanding amount and indemnify the Landlord against losses arising directly from that non-payment, strictly within the limits of this Guarantee.

Any amount properly due shall be paid within 14 days of written demand from the Landlord or Landlord's Agent.

 

JOINT AND SEVERAL LIABILITY

The Guarantor acknowledges that the tenancy is joint and several and that the Guaranteed Tenant may therefore be liable for the whole rent and other joint obligations under the tenancy, and not merely an individual share.

This Guarantee applies to the whole amount for which the Guaranteed Tenant is legally liable. Nothing in this Guarantee makes the Guarantor liable for any amount which the Guaranteed Tenant is not legally liable to pay.

 

DURATION OF THE GUARANTEE

The Guarantee begins on the tenancy commencement date and continues while the Guaranteed Tenant remains legally responsible for the tenancy, subject to the agreed limitations and applicable law.

The Guarantee does not automatically end following a lawful rent increase, additional time to pay, or changes to other joint tenants. However, the Guarantor's agreed liability shall not increase without their express written consent.

Future liability ends when the Guaranteed Tenant's tenancy obligations have lawfully ended. Any liability arising before that date remains subject to the limits of this Guarantee.

 

DEATH OF THE GUARANTEED TENANT

This Guarantee is subject to statutory limitations following the death of the Guaranteed Tenant. No liability shall arise where excluded by law, and the Guarantor shall not become responsible for surviving joint tenants' obligations.

References to the Landlord include House Hunt Selly Oak Ltd acting as the Landlord's Agent and anyone authorised to act on the Landlord's behalf.

 

DEATH OF THE GUARANTOR

The death of the Guarantor does not release any liability which arose before their death. The Guarantor's estate remains liable for those obligations to the extent permitted by law.

 

DATA PROTECTION AND REFERENCING

The Guarantor agrees to House Hunt Selly Oak Ltd carrying out reasonable identity, credit and referencing checks in connection with the tenancy and this Guarantee.

Personal information may be used for the administration and management of the tenancy and, where necessary and lawful, shared with relevant third parties including the Landlord, referencing providers, contractors, local authorities and utility suppliers.

Personal information will be processed and retained in accordance with applicable data protection law and House Hunt Selly Oak Ltd's Privacy Policy.

 

GUARANTOR'S DECLARATION

By signing this Guarantee, the Guarantor confirms that:

• I understand the nature and limited financial liability of this Guarantee and indemnity
• I understand that the tenants are jointly and severally liable for the full tenancy obligations, but my liability is limited to the named Guaranteed Tenant's agreed individual share of rent only.
• I understand that I am not liable for any other tenant's unpaid rent or obligations.
• I confirm that the information provided is true and complete to the best of my knowledge.
