GUARANTEE AND INDEMNITY
In consideration of the Landlord granting or continuing the tenancy to the Guaranteed Tenant, the Guarantor agrees to be responsible for all rent and other obligations for which the Guaranteed Tenant is legally liable under the tenancy agreement.
If the Guaranteed Tenant fails to pay any rent or other sum due, or breaches an obligation under the tenancy, the Guarantor agrees to pay the sums due and reimburse the Landlord for any reasonable losses, damages, costs or expenses arising from that failure, provided that the Guaranteed Tenant is legally liable for those sums.
Any amount properly due from the Guarantor shall be paid within 14 days of written demand from the Landlord or Landlord's Agent.
JOINT AND SEVERAL LIABILITY
The Guarantor acknowledges that the tenancy is joint and several and that the Guaranteed Tenant may therefore be liable for the whole rent and other joint obligations under the tenancy, and not merely an individual share.
This Guarantee applies to the whole amount for which the Guaranteed Tenant is legally liable. Nothing in this Guarantee makes the Guarantor liable for any amount which the Guaranteed Tenant is not legally liable to pay.
DURATION OF THE GUARANTEE
The Guarantor's obligations begin on the commencement date of the tenancy and continue for as long as the Guaranteed Tenant remains a party to the tenancy.
The Guarantee will not automatically end because the rent is lawfully increased, the Landlord gives additional time to pay, or another joint tenant leaves, joins or is replaced, provided the Guaranteed Tenant remains a tenant and subject always to applicable law.
Future liability ends when the Guaranteed Tenant has ceased to be a party to the tenancy. This does not affect liability which arose before that date.
DEATH OF THE GUARANTEED TENANT
This Guarantee is subject to any statutory limitations on a guarantor's liability following the death of the Guaranteed Tenant. Nothing in this Guarantee is intended to make the Guarantor liable for rent or any other sum where such liability is excluded or limited by applicable law.
References to the Landlord include House Hunt Selly Oak Ltd acting as the Landlord's Agent and anyone authorised to act on the Landlord's behalf.
DEATH OF THE GUARANTOR
The death of the Guarantor does not release any liability which arose before their death. The Guarantor's estate remains liable for those obligations to the extent permitted by law.
DATA PROTECTION AND REFERENCING
The Guarantor agrees to House Hunt Selly Oak Ltd carrying out reasonable identity, credit and referencing checks in connection with the tenancy and this Guarantee.
Personal information may be used for the administration and management of the tenancy and, where necessary and lawful, shared with relevant third parties including the Landlord, referencing providers, contractors, local authorities and utility suppliers.
Personal information will be processed and retained in accordance with applicable data protection law and House Hunt Selly Oak Ltd's Privacy Policy.
GUARANTOR'S DECLARATION
By signing this Guarantee, the Guarantor confirms that:
- I have received the tenancy agreement and had sufficient opportunity to read it.
- I understand the nature and potential financial liability of this Guarantee and indemnity.
- I understand that the tenancy is joint and several and that the Guaranteed Tenant may be liable for the whole rent and other joint obligations, not only an individual share.
- I have had the opportunity to obtain independent legal advice.
- I confirm that the information I have provided is true and complete to the best of my knowledge.
