WAIVER AND RELEASE FROM LIABILITY FOR USE OF
FITNESS GENERATION CALIFORNIA INC. EXERCISE FACILITY
Introduction
By signing this Waiver of Release and Liability, you acknowledge and agree to the terms outlined below related to your use of the facilities, equipment, and services provided by Fitness Generation California, Inc., dba The Fitness Edge (hereinafter referred to as "TFE"). This waiver includes participation in or use of all activities, equipment, classes, or any other amenities offered by TFE, including, but not limited to, weight/cardio training, personal training, instructor-led classes, video classes, infrared sauna, massage/stretch therapy, and devices/equipment associated with the recovery area.
Assumption of Risk
•All activities and services provided may involve risks to health and safety, including but not limited to physical injury, mental strain, or adverse reactions to treatments or equipment.
•You voluntarily assume any and all risks associated with the use of facilities, services, and equipment.
•It is your responsibility to consult a medical professional prior to using services or engaging in physical activities at Facility. You understand that our instructors, therapists and other employees are not medical personnel and are not qualified to provide medical advice. Any information or assistance provided by our employees should not be construed as professional medical guidance.
Participant Responsibility
•You agree to follow all rules, guidelines, and instructions provided by TFE and its staff.
•You will notify the staff of any pre-existing medical conditions or limitations that may affect your ability to safely participate in activities or use equipment.
Release of Liability
•By signing this waiver, you, your heirs, assigns and next of kin release TFE, its owners, agents, employees, instructors, therapists, and affiliates and assigns of and from any claims, demands, debts, contracts, expenses, causes of action, lawsuits, damages and liabilities, or every kind of nature, whether known or unknown, in law or equity, arising from or in any way related to personal injury, property damage, or any other liabilities associated with the use of its services and equipment.
•This release applies to injuries or damages sustained as a result of negligence, accidents, equipment malfunctions or any unforeseen incidents occurring during the use of the facilities and services.
Indemnification
You agree to indemnify and hold harmless TFE, its owners, employees, instructors, therapists, and affiliates from any claims, legal fees, or expenses arising due to your use of the facilities or services.
Miscellaneous
•This waiver is governed by the laws of the jurisdiction where the facility operates.
•If any clause within this waiver is deemed unenforceable, the remaining portions shall remain in full effect.
•This waiver remains valid for all future visits unless explicitly revoked in writing.
•This waiver will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of TFE, whether by agreement, operation of law, or otherwise.
Signature and Agreement
By signing below, you acknowledge that you have read, understood, and voluntarily agreed to the terms of this waiver of liability. You affirm that you are 18 years of age or older and mentally competent to sign this waiver.
