What is a Statutory Demand?
If the debt is due and payable, undisputed, and meets the minimum threshold, we can issue a Statutory Demand.
This is a powerful legal step. It requires the debtor to either:
- Pay the debt;
- Reach a compromise/settlement; or
- Apply to court to have the demand set aside.
Important:
If the debtor successfully proves there is a genuine dispute, the court may order you to pay their legal costs.
If you are unsure, choose “Talk to a solicitor” before proceeding.
To issue a statutory demand, we will send you a form to sign before a Justice of the Peace or Solicitor, confirming that the debt is owing.
