Effective as of Jan 1st, 2025
By providing your debit card or ACH payment information ("Payment Information") to Consturction Care Consulting LLC ("the Company", "we", "our", or "us"), you (the "Contractor", "you", or "your") agree to the following Terms and Conditions:
1. Payment Authorization
1.1. You authorize Construction Care Consulting LLC to collect and store your debit card or ACH payment information for the purpose of processing payments related to Contractor Permit Fees administered by State of Florida Municipalities and any invoicing fees for newly submitted permits, as applicable.
1.2. You acknowledge and agree that the Company may charge your Payment Information for fees as outlined in the associated invoices and agreements.
2. Payment Processing
2.1. The Company will process payments related to Contractor Permit Fees and associated invoicing fees at the time specified in your invoice or agreement.
2.2. You agree to maintain accurate and up-to-date Payment Information with the Company. In the event of a change in your Payment Information, you must promptly provide updated details to ensure timely processing of payments.
3. Declined Payments
3.1. If your Payment Information is declined for any reason, you will have two (2) business days from the date of the declined payment notification to submit an alternative form of payment.
3.2. If a new form of payment is not received within two (2) business days, the processing of the associated project(s) may be delayed, paused, or suspended until payment is rectified.
3.3. The Company reserves the right to withhold work or permit processing until all outstanding payments have been made, including any fees for payment failure or resubmission.
4. Refunds and Disputes
4.1. Payments for permit fees and invoicing fees are non-refundable once processed.
4.2. If the submitted project does not move forward for any reason, the permit will be moved to cancelled and the Contractor will not receive a refund or credit for that project.
5. Security and Confidentiality
5.1. The Company takes reasonable measures to protect the confidentiality and security of your Payment Information, in accordance with applicable data protection laws.
5.2. By providing your Payment Information, you consent to the collection, storage, and processing of your data as outlined in the Company's Privacy Policy.
6. Modifications to Terms
6.1. The Company reserves the right to modify or update these Terms and Conditions at any time, and such changes will be effective immediately upon posting on the Company's website or communication to you.
6.2. Your continued use of the payment services after any such changes will constitute your acceptance of the modified Terms and Conditions.
7. Limitation of Liability
7.1. The Company shall not be liable for any indirect, incidental, or consequential damages arising from the processing of payments, including but not limited to any delays, suspensions, or issues arising from payment declines or failures.
8. Governing Law
8.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
Acknowledgment
By submitting your payment information to Construction Care Consulting LLC, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
