VENDOR TERMS AND CONDITIONS
1. Application Approval
Submission of an application does not guarantee acceptance. The BIG Plant Market carefully curates each event to provide attendees with a diverse selection of vendors specializing in rare and uncommon indoor and outdoor plants, plant supplies, plant-related products, and handmade artisan goods. Vendor selections are made based on event needs, product variety, available space, and overall market balance.
2. Setup Requirements
All vendors must arrive and be fully checked in no later than one (1) hour prior to the scheduled market opening time unless otherwise instructed by event management.
Vendors arriving after the market has opened may be denied setup and participation without refund.
3. Booth Space Assignments
Booth placements are generally assigned in the order applications are received, approved, and paid. Event management reserves the right to make adjustments as necessary to accommodate venue requirements, event flow, safety considerations, sponsor obligations, and overall market layout.
Vendors requiring additional space or special accommodations must contact event management prior to the event.
4. Vendor Responsibilities
Vendors are solely responsible for the setup, operation, and breakdown of their booth space.
All inventory, equipment, displays, packaging materials, and trash must be removed from the venue at the conclusion of the event. Vendors may be charged for any cleanup fees assessed by the venue as a result of items left behind.
5. Professional Conduct
Vendors agree to maintain a professional and respectful relationship with attendees, fellow vendors, venue staff, sponsors, volunteers, and event management at all times.
Harassment, disruptive behavior, abusive language, intimidation, or conduct deemed harmful to the event, its attendees, or its reputation may result in immediate removal without refund and may affect eligibility for future events.
6. Vendor Fees and Cancellation Policy
All vendor fees are non-refundable and non-transferable.
a. Event Cancellation or Rescheduling
If The BIG Plant Market must cancel or postpone an event due to weather, venue issues, government restrictions, force majeure events, or other circumstances beyond its reasonable control, event management will make reasonable efforts to reschedule the event.
If a rescheduled date is offered and a vendor is unable to attend, no refund, credit, or transfer will be issued.
Vendor spaces may not be transferred, sold, assigned, or credited toward another event.
If the event cannot be rescheduled, a partial refund may be issued at the discretion of event management, less marketing, administrative, payment processing, and event preparation expenses incurred on behalf of the vendor.
b. Vendor Cancellation
Vendors who cancel within ten (10) days of an event may have future applications reviewed at the discretion of event management. Repeated cancellations may impact eligibility for future participation.
7. Weather Policy
The BIG Plant Market operates rain or shine unless otherwise announced by event management. A vendor's decision not to attend due to weather conditions does not qualify for a refund, credit, transfer, or rescheduled space.
8. Product Restrictions
The BIG Plant Market reserves the right to prohibit the sale, display, or distribution of any item deemed unsafe, illegal, counterfeit, offensive, hazardous, inappropriate, or inconsistent with the event's mission, audience, venue requirements, or applicable laws.
9. Licenses and Legal Compliance
Vendors are solely responsible for obtaining and maintaining all licenses, permits, certifications, registrations, tax filings, nursery certifications, and other approvals required by federal, state, and local law.
Participation in The BIG Plant Market does not relieve vendors of any legal obligations associated with operating their business.
10. Photography and Media Release
Vendor grants The BIG Plant Market, The BIG Plant Expo, and their representatives permission to photograph, film, record, and otherwise capture images of vendor booths, products, displays, logos, business names, employees, representatives, and related activities during the event.
Vendor authorizes the use of such photographs, videos, recordings, and materials for promotional, advertising, educational, editorial, historical, and marketing purposes in any media now known or later developed without compensation or further approval.
11. Shared Booths and Transfers
Vendors may not share, transfer, assign, sell, sublease, or otherwise allow another business or individual to occupy any portion of their booth space without prior written approval from event management.
12. No Guarantee of Sales or Attendance
The BIG Plant Market makes no guarantees regarding attendance, customer traffic, sales volume, profitability, weather conditions, vendor placement, media coverage, or business results.
Vendor acknowledges that participation is undertaken at their own business risk.
13. Force Majeure
The BIG Plant Market shall not be liable for cancellations, delays, interruptions, modifications, venue changes, or other event impacts caused by acts of God, severe weather, natural disasters, public health emergencies, government actions, labor disputes, utility failures, venue closures, civil disturbances, or other circumstances beyond its reasonable control.
14. Marketing Participation
Vendors agree to actively promote their participation in The BIG Plant Market through their social media platforms, websites, email newsletters, and other marketing channels when applicable.
The BIG Plant Market agrees to promote participating vendors through its marketing efforts, which may include social media, website listings, email campaigns, paid advertising, and event materials.
To be included in vendor spotlights, social media promotions, and other marketing campaigns, completed applications, logos, photos, and any required fees must be submitted by the deadlines established for each event.
15. Event Management Rights
The BIG Plant Market reserves the right to refuse, revoke, or terminate vendor participation at any time for violations of event policies, venue regulations, safety requirements, local laws, or conduct deemed detrimental to the event.
Event management also reserves the right to modify event hours, vendor locations, booth assignments, venue layouts, event operations, and other logistical arrangements as necessary.
No refund shall be issued in the event of removal for policy violations.
16. Agreement
By submitting an application and participating in The BIG Plant Market, Vendor acknowledges that they have read, understood, and agree to these Vendor Terms and Conditions.
