WAIVER AND RELEASE

By signing the last page of this document, you knowingly and willingly release all parties involved (including but not limited to) any and all organizers, directors, volunteers, and participants of any and all liability for any injuries, actions, or omissions associated with the 2025 BOBBY LANE CUP tournament (hereinafter at times referred to as “the Tournament”.)Please read the following and sign in the designated area(s) on the last page. Note: You are not an authorized participant unless you have knowingly signed this document. ALL ANGLERS, CAPTAINS, AND VOLUNTEERS MUST SIGN THE FOLLOWING WAIVER AND RELEASE OF LIABILITY AND NAME AND LIKENESS RELEASE. As a condition of my being permitted to be a competitor, or to other participate in the BOBBY LANE CUP events, an opportunity available to youth in a limited age range, and for other goods and valuable consideration, the receipt and sufficiency of which is hereby acknowledged and intending to be legally bound, I agree to the following:
Name and Likeness Release*

I, the undersigned [the registered individual 18 years or older/ the parent or legal guardian of the registered minor], hereby knowingly, willingly, and irrevocably grant unlimited permission to the BOBBY LANE CUP its sponsors, licensees and assigns (collectively the “Distributors”) to without limitation and in perpetuity, to utilize my or my child's appearance, performance, name, voice and likeness for (without limitation) any and all productions, promotions, or other manner. I hereby knowingly and willingly waive any right that I may have to inspect or approve any finished product or any advertising copy that may be used in connection hereto. I hereby warrant that I have the legal right and authority to make this release and grant this license and that my granting this release and license and the rights conveyed thereby will not infringe the rights of any third party.
Live Stream, Photography, and Media Consent*

I, the undersigned [the registered individual 18 years or older/ the parent of legal guardian of the registered minor], understand that the BOBBY LANE CUP may record, photograph, or live stream all or part of the Tournament, including on-boat camera footage, interviews, and live audio. I hereby grant the BOBBY LANE CUP ,its partners, sponsors, assigns, and media representatives the irrevocable right to record, use, reproduce, and distribute my or my child's name, likeness, image, voice, and performance in connection with any live stream, broadcast, video, social media post, or promotional content related to the Tournament, without restriction or compensation. I acknowledge that live streaming may include real-time audio and video captured during competition and agree to conduct myself in a professional manner while on camera and on a live microphone. If my child is under 18 years of age, I, the parent or legal guardian, also grants permission for such recording and publication on behalf of the minor participant.
Physical Condition*

I, myself an individual 18 years or older; or I, the parent or legal guardian of the registered minor, am vouching that I, myself an individual 18 years or older, or my minor child, is physically fit to compete or otherwise participate in the BOBBY LANE CUP event(s) and activities, and have not been advised otherwise by a medical practitioner.
Equipment and Facilities Inspection*

I, the registered individual 18 years or older, or the parent or legal guardian of the registered minor, agree that before I/my child participates in the BOBBY LANE CUP events (whether it be as a participant, volunteer, or otherwise) in events and activities, that I/my child will inspect the related facilities and equipment. I, [the undersigned parent or legal guardian], I [the registered individual 18 years or older], or the registered minor, will immediately advise the Tournament Director of any unsafe condition that they observe. I, [the undersigned parent or legal guardian], I [the registered individual 18 years or older], or the registered minor further acknowledge, agree, and affirm that they will refuse to participate in any event or activities until all unsafe conditions observed by I, [the undersigned parent or legal guardian], I [the registered individual 18 years or older], or the registered minor have been remedied and/or no longer exist.
Assumption of Risk*

I, the undersigned [the registered individual 18 years or older/ the parent of legal guardian of the registered minor], understand that each and every participant in the events and activities of the BOBBY LANE CUP may be engaging in activities that involve the risk of serious personal injury, illness, permanent disability, dismemberment and death, and may also involve the risk of severe economic and property loss and damage. I understand that these risks may result from the actions, negligence, fault, omission and failure to act of any registered angler, captain, and/or others (including but not limited to, the BOBBY LANE CUP, and other participants in, and the sponsors, advisors, organizers and volunteers of the event and from the rules of play, the challenges of the event and activities of the event and the condition of any property, facilities or equipment used. I also understand that there may be risks involved which are not known to me or to the BOBBY LANE CUP, advisors, sponsors, organizers, and other volunteers, and may not be foreseen or reasonably foreseeable by any of them or us at this time or at the time of the BOBBY LANE CUP events. I knowingly and willingly assume all of the foregoing risks including the risk of any negligence by other participants, advisors, organizers, sponsors or volunteers of the event, and their respective owners, directors, officers, employees or agents, and the risk of injury caused by the condition of any property, facilities or equipment used during the events or activities and accept personal responsibility for any injury (including, but not limited to, personal injury, disability, dismemberment and death), illness, damage, loss, claim, liability or expense, of any kind or nature, that I or my property may suffer arising out of or in connection with the event, and activities or my participation therein or attendance thereat. This agreement will include travel to and from the Lake to a remote weigh-in site. I understand and agree that this assumption of risk extends to all tournament-related travel, pre-event practice, and post-event activities.
Liability Release and Indemnity Agreement*

I, the undersigned[the registered individual 18 years or older/ the parent of legal guardian of the registered minor], hereby release and forever discharge and agree to save and hold harmless ROBERT LANE JR., BOBBY LANE FISHING, LLC, BOBBY LANE HIGH SCHOOL CUP, INC. ,THE BOBBY LANE CUP and all of their respective parents, employees, agents, volunteers, and their subsidiaries, subsidiaries of its parents and their affiliates, advisors, and other volunteers associated or affiliated with the event or activities, the owners, lessors and lessees of the property, facilities and equipment used in connection with the event, and activities of the Tournament, including without limitation the respective organizers, directors, officers, employees and agents of all of them, and the other participants in the event or activities (each such entity or individual being referred to as a “Released Party”) of and from any and all injuries (including personal injury, disability, dismemberment, and death), illness, losses, damages, claims, liabilities or expenses (including attorneys’ fees) of any kind or nature (and whether accruing to me, my heirs or my personal representatives) that are caused or alleged to be caused in whole or in part by my action, negligence, fault, omission, failure to act, or by my breach or alleged breach of this Waiver and Release, or by the condition of the property, facilities or equipment of any Released Party or that arise out of or in connection with the event or my participation therein or attendance thereat. By signing this waiver, I acknowledge that participation in the 2025 BOBBY LANE CUP (the “Tournament”) involves inherent risks, including but not limited to those associated with boating, fishing, weather, water conditions, and the actions of other participants. I voluntarily assume all such risks. In consideration of being allowed to participate, I hereby release, discharge, and agree to indemnify, defend, and hold harmless ROBERT LANE JR., BOBBY LANE FISHING, LLC, BOBBY LANE HIGH SCHOOL CUP, INC. ,THE BOBBY LANE CUP, and all of their respective parents, employees, agents, volunteers, and their subsidiaries, subsidiaries of its parents and their affiliates, advisors, and other volunteers associated or affiliated with the event or activities, the owners, lessors and lessees of the property, facilities and equipment used in connection with the event, and activities of the Tournament, including without limitation the respective organizers, directors, officers, employees and agents of all of them, and the other participants in the event or activities (each such entity or individual being referred to as a “Released Party”), its officers, directors, employees, agents, sponsors, volunteers, and affiliates (collectively, the “Released Parties”) from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to my participation in the Tournament, including but not limited to personal injury, death, property damage, or loss, whether caused by negligence or otherwise, except to the extent caused by the gross negligence or willful misconduct of the Released Parties. I further agree that this release and indemnification shall be binding upon my heirs, executors, administrators, and assigns, and shall apply to any claims arising before, during, or after the Tournament. If any provision of this agreement is found invalid, the remaining provisions shall remain in full force and effect.
Arbitration and Related Topic*

By signing this waiver, the participant and all related parties agrees that any dispute, claim, or controversy arising out of or relating to participation in the Tournament, including but not limited to interpretation, enforcement, or breach of this agreement, shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Florida before a single arbitrator mutually agreed upon by the parties or, if they cannot agree, appointed in accordance with the AAA rules. The decision of the arbitrator shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction. Each party shall bear its own attorneys’ fees and costs, and the costs of arbitration shall be shared equally unless otherwise determined by the arbitrator. The participant and all related parties expressly waives any right to bring or participate in a lawsuit and hereby knowingly, willingly, and voluntarily releases his/her right to any jury trial against ROBERT LANE JR., BOBBY LANE FISHING, LLC, BOBBY LANE HIGH SCHOOL CUP, INC. ,THE BOBBY LANE CUP, and all of their respective parents, employees, agents, volunteers, and their subsidiaries, subsidiaries of its parents and their affiliates, advisors, and other volunteers associated or affiliated with the event or activities, the owners, lessors and lessees of the property, facilities and equipment used in connection with the event, and activities of the Tournament, including without limitation the respective organizers, directors, officers, employees and agents of all of them, and the other participants in the event or activities (each such entity or individual being referred to as a “Released Party”), except to enforce an arbitration award.
Damages*

In no event shall the Released Parties be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to participation in the Tournament, even if advised of the possibility of such damages.
Medical Treatment*

In connection with any injury or illness or other medical conditions I, being of legal age, or my under legal age child, may experience during my/their participation in or attendance at the Event; I, the legal age participant or legal guardian of under legal aged participant, authorize any emergency first aid, medication, medical treatment or surgery deemed necessary by the attending medical personnel if I, the legal age participant or legal guardian of under legal aged participant am not able to act on my own behalf, or if parent or legal guardian is not present. I, legal age participant or legal guardian of under legal age participant, further authorize the attending medical personnel to execute on my behalf any permission forms, consents or other appropriate documents relating to medical attention and to act on my behalf if I am not able or immediately available to do so, or the parent or guardian is not present.
Licensure and Insurance*

Any participant of the 2025 BOBBY LANE CUP who operates a vessel during the Tournament must possess a valid Florida Boating Safety Certification/License as required by the Florida Law Enforcement Agency and other applicable state law(s). By signing this waiver, the participant certifies that they hold such a valid boating license and will carry it on their person or vessel at all times while participating in the Tournament. Failure to possess or present proof of a valid Florida Boating License upon request by Tournament Officials or law enforcement authorities will result in immediate disqualification and forfeiture of any entry fees or prizes. Each participant further agrees to comply with all Florida boating laws, safety regulations, and equipment requirements while operating a vessel in connection with the Tournament. Each participant is required to maintain, at their own expense, a valid liability insurance policy with limits of not less than Three Hundred Thousand Dollars ($300,000) per occurrence. Such insurance must provide coverage for bodily injury, property damage, and personal liability arising out of or in connection with the operation of any boat or equipment used during the Tournament. Participants shall, upon request, provide proof of insurance satisfactory to the Tournament Officials prior to participation. Failure to provide proof of required coverage or maintain such insurance during the Tournament will result in disqualification and forfeiture of any entry fees or prizes.
Severability of Provisions*

I, the undersigned [the registered individual 18 years or older/ the parent of legal guardian of the registered minor] agree that the foregoing agreements are intended to be as broad and inclusive as is permitted by Florida law. Any provisions herein found by a court to be void or unenforceable shall not affect the validity or enforceability of any other provisions.
I, the undersigned [the registered individual 18 years or older/ the parent of legal guardian of the registered minor], HAVE CAREFULLY READ AND FULLY UNDERSTAND THIS WAIVER AND RELEASE OF LIABILITY AND NAME AND LIKENESS RELEASE. I UNDERSTAND THAT BY SIGNING BELOW, I, the undersigned [the registered individual 18 years or older/ the parent of legal guardian of the registered minor], AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I, the undersigned [the registered individual 18 years or older/ the parent of legal guardian of the registered minor], AM SIGNING THIS WAIVER AND RELEASE VOLUNTARILY AND OF MY OWN FREE WILL. By typing or drawing my name below, I agree that my electronic signature constitutes a legal signature under the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN, 15 U.S.C. §7001) and the Florida Uniform Electronic Transactions Act (UETA) (codified in Section 668.50 of the Florida Statutes). This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions.
