WAIVER, RELEASE AND ASSUMPTION OF RISK
BY SIGNING BELOW, YOU GIVE UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. READ CAREFULLY.
I hereby acknowledge and agree that in consideration of being allowed to participate in the hockey tournament organized by Bell Canada, which will run from Friday, March 27, 2026 to Saturday, March 28, 2026 at the Canlan Sports York ice rinks in Toronto, Ontario (the “Bell Hockey Classic”):
- I hereby release Bell Canada, its affiliates, its employees, volunteers, officers and directors and its sponsors, including those of its affiliates, (collectively the “Releasees”) from all recourses, claims, and causes of action of any kind whatsoever, in respect of all personal injuries, including death, or property losses which I may suffer arising out of my participation in the Bell Hockey Classic, notwithstanding that such injuries or losses may have been causes solely or partly by the negligence of the Releases.
- I acknowledge that the sporting events and activities that I will be participating in connection with the Bell Hockey Classic inherently involve a risk of physical injury, even death, as well as property loss and potential exposure to infectious and communicable disease, including but not limited to COVID-19. I nevertheless freely and voluntarily assume all the aforesaid risks and hazards, and that, accordingly, my participation in the Bell Hockey Classic shall be entirely at my own risk.
- I confirm that I am at least eighteen (18) years of age and in good physical health and capable of participating in the Bell Hockey Classic and suffer from no disability that would prevent me from participating or would render me susceptible to injury as a result of participating in the Bell Hockey Classic.
- I assume any and all risks associated with my participation in the Bell Hockey Classic howsoever caused. I further acknowledge that the Releases cannot guarantee my safety during my participation and that the Releases make no warranties, guarantees or representations about my participation or the risks or safety of participating in the Bell Hockey Classic.
- I hereby give the Releases the irrevocable right and permission to use, broadcast, copy, publish, reproduce and distribute photographs or videos of me taken as part of my participation in the Bell Hockey Classic, for example on Bell Canada's internal and external websites and social medias such as YouTube, Facebook, LinkedIn, Instagram, TikTok and Twitter or any other media, including brochures, newspapers, television and radio, already known or to be known in the future, throughout Canada and the rest of the world, without compensation, permission or notice.
- I waive my right to privacy, my right of publicity and all my rights, title and interest in and to photographs and videos of me taken in connection with the Bell Hockey Classic.
- I also understand that due to the nature of the World Wide Web and current technology, the Releases may not be able to control my image after publication and, therefore, I release the Releases and all persons acting under its authority or authorization from any and all claims that may arise from unauthorized use by a third party of my image.
- I have been given the opportunity and have been encouraged to seek independent legal advice prior to signing this agreement;
- I have been given the opportunity and have been encouraged to seek the advice of an independent medical practitioner regarding my participation in the Bell Hockey Classic prior to signing this agreement;
- I understand that this agreement is binding on myself, my heirs, executors, administrators, personal representatives and assigns;
I have carefully read and understood this WAIVER, RELEASE AND ASSUMPTION OF RISK and I freely agree to be legally bound by it.
