ASSUMPTION OF RISK
In consideration of participating in the sport of paintball. I represent, that I understand the nature of this activity and that I am qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participating in the Activity. I fully understand that this activity involves risks of serious bodily injury, including permanent disability, paralysis, and death, which may be caused by my own actions, or inactions, those of others participating in the event, the conditions in the which the event takes place, or the negligence of the “releases” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the paintball activity.
INDEMNITY AGREEMENT AND LIABILITY WAIVER
I hereby release, discharge, and covenant not to sue SFR PAINTBALL LLC and/or SOUTH MIAMI SUPRA CORP, its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and if applicable, owners and lessors of premises on which the activity takes place, (each considered one of the RELEASES herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the “releases” or otherwise, including negligent rescue operations; and | further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releases, I will indemnify, save, and hold harmless each of the releases from any loss, liability, damage, or cost which any may incur as the result of such claim. I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, and fully understand that I have given up substantial rights by signing it and have signed it freely and without any inducement and assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be valid the balance, not withstanding, shall continue in full force and effect.
PAINTBALL SAFETY RULES
Always wear approved goggles within any playing area or in any area marked as a goggle required area. In any playing area or other area marked as a goggle required area, you may not remove your goggles for ANY reason including, but not limited to: fogging, lenses covered in paint, or in case of injury.
A barrel blocking device (barrel cover) must be used when not shooting or in a play area.
You may not shoot at or aim a marker at any person who is not wearing goggles.
You may not shoot at any non-participant wearing a spectator or media vest, referee jersey or any bird or animal.
You may not fire your marker into the air.
You may not purposefully shoot at sensitive areas on the body of other players.
You may not shoot someone who has identified themselves as being “hit" or “out” or who a referee has called out.
All paintball markers must be chronographed prior to play and may shoot at velocities no greater than 290 FPS.
Firearms, knives, and other weapons are STRICTLY prohibited.
No physical contact between players.
Consumption of illegal substances on the premises is strictly forbidden.
Never look down the barrel of your paintball marker for ANY reason.
You may not climb any tree on the property for any reason.
You may not engage in any play or spectate on the property without signing a safety waiver.
You must follow the directions of referees and other field employees at all times.
We reserve the right to refuse participation to anyone for any reason. There are no refunds of field fees, rental fees or exchanges of any unused product if you are asked to leave the property because of violation of any of these rules.
