1. Rules and Regulations: The camper ( Camper ) and parent(s) ( Parent ) agree to abide by all of the rules and regulations established by Camp Success ( Camp ) including, without limitation, those relating to enrollment and withdrawal of campers and visitation. The Summer 2026 season dates are Sunday, August 16th through Saturday, August 22nd .
2. Payment and cancellation: Payment terms are a $1000 deposit to accompany enrollment; $1000 dollars 30 days after enrollment and $500 dollars 45 days after enrollment. For all enrollments received June 1 or later, the full tuition of $2500, will be charged at the time of enrollment. After June 1, no payments will be refunded. There will be 3% credit card processing fee added to enrollments that are charged on a credit card.
3. The Camp reserves the right to issue credits in lieu of scheduled refunds in the unlikely event of an Act of God, War, Terrorism, Civil Unrest, Communicable Disease, Epidemic, Pandemic or any other non-personal situation that, in the Camp’s sole judgment, could lead to significant cancellations that would have a negative financial impact on the future of the Camp.
4. Dismissal of Campers: The Camp reserves the right to dismiss, in its sole discretion, any Camper whose condition, conduct, influence or behavior is deemed unsatisfactory or detrimental to the best interests of the Camp or his fellow campers or who violates camp rules and regulations, in which case no refunds will be made.
5. Medical Care: Medical care provided by the Camp physician is included in the tuition. Parent grants Camp permission to utilize medical treatment (including dental and orthodontic) outside of Camp should the Camp Director(s) deem such treatment necessary for Camper’s well being. Should it be necessary for the well being of the Camper to receive outside medical care, all expenses incurred shall be paid by Parent. In addition, any dental, orthodontic, or optical work shall be paid by Parent.
6. Camper Medical Information: Parent must inform the Camp Directors prior to registration if Camper has received professional counseling or medication for behavioral modification during the last 12 months. Parent must also inform the Camp Directors immediately if such care or medication occurs after registration and prior to the camp season. Failure to so inform the Camp Directors may lead to dismissal of Camper from Camp, and in the event of such dismissal, no refund will be issued.
7. Late arrival/early departure: No allowance or reduction in tuition will be made for later arrival or early departure of Camper without the Directors’ written consent prior to the start of the camp season. There will be an adjustment made if the camper’s health necessitates an early departure.
8. Permission to participate: Parent grants permission for Camper to participate in all Camp activities, excursions, and special outings and understands that accidents and injuries may occur in the natural course of participation in such activities. Parent represents and warrants that Parent has explained Camp’s Policies to Camper, that Camper understands those policies and will abide by them, and that Parent has instructed Camper on the importance of following those policies.
9. Images, etc: Permission is hereby given for Camp to use in promoting the Camp and in other ventures directly relating to the Camp (i) digital, photographic, video, and audio images or likenesses of camper; and (ii) statements, articles, names, music, art, photographs, audio recordings, films and videos created by Camper or originating from Camp or from a Camp related activity.
10. Belongings: Camp is not responsible for Camper’s belongings or equipment while in camp.
11. Tipping: Tipping of staff is prohibited.
12. Compliance with state regulations: Parent may request copies of the Camp’s background check, health care and discipline policies as well as procedures for filing grievances, all in accordance with the Massachusetts regulations governing summer camps. The camp must comply with regulations of the Massachusetts Department of Public Health and be licensed by the local Board of Health.
13. INDEMNIFICATION: Parent shall indemnify and hold harmless Camp, its members, managers, officers, directors, employees, staff, parent companies and affiliated companies, (each an “Indemnified Party”) for any claims, costs, losses, damages and attorneys’ fees resulting from: (a) Parent or Camper’s breach of this Application of Enrollment (the “Agreement”); (b) Camper’s violation of any rules, regulations or policies established by the Camp; (c) claims brought by Parent or Camper; and/or (d) claims by Camp to collect tuition, fees or other losses or damages. In the event that tuition or fees are not paid in full for Camper, Parent will be liable for all costs of collection, including attorneys’ fees.
14. Effective date; Disputes: This Application of Enrollment (the Agreement) shall take effect and become binding when (a) signed by parent, (b) returned to Camp, and (c) accepted by Camp. All claims or disputes asserted by Camper or Parent against the Camp and arising from or related to this Agreement shall be brought and maintained in the courts of the Commonwealth of Massachusetts (County of Berkshire), and Parent expressly submits to the jurisdiction of such courts. The substantive law of the Commonwealth of Massachusetts will govern such disputes without regard to conflict of law rules. Any individual bringing legal action against Camp, which action is decided in favor of Camp, will be responsible for all legal fees, court costs and out-of-pocket expenses of Camp, its owners and employees.
15. WAIVER: No waiver of any breach of any provision of this Agreement shall constitute a waiver of any other breach of that or any other provision hereof.
16. SEVERABILITY: If any provision of this Agreement shall be deemed invalid or unenforceable, the balance of this Agreement shall remain in effect, and if any provision shall be deemed inapplicable to any person or circumstances, it shall nevertheless be construed to apply to all other persons and circumstances.
