  • WAIVER AND RELEASE OF LIABILITY AGREEMENT

    Woodland Saunas Inc. dba Oyama Public Sauna
    Public Sauna Use – 16012 Oyama Rd, Lake Country, BC V4V 2E4

    PLEASE READ CAREFULLY BEFORE SIGNING:
    In consideration of my participation in sauna services and related experiences (the “Services”) provided by Woodland Saunas Inc., doing business as Oyama Public Sauna (the “Facility”), located at 16012 Oyama Rd, Lake Country, BC V4V 2E4, I, the undersigned, hereby acknowledge and agree as follows:

    1. RELEASE AND WAIVER OF LIABILITY
    I voluntarily assume all risks associated with the use of the sauna, cold shower, and related facilities. I hereby release, discharge, and covenant not to sue Woodland Saunas Inc., its directors, officers, employees, agents, representatives, insurers, successors, assigns, and any property owners (collectively, the “Released Parties”) from any and all claims, losses, damages, or liabilities, INCLUDING LOSSES DUE TO THE NEGLIGENCE OF RELEASED PARTIES, resulting in personal injury (including death), illness, accidents, or property loss, including theft, arising from my participation in the Services or use of the Facility.

    The Released Parties are not liable for any loss or theft of personal property, including jewelry or valuables. In no event shall the Released Parties’ liability exceed $1,000, and only if the item was previously registered with the Facility and the loss was caused solely by the fault of the Released Parties.

    2. NON-MEDICAL SERVICES DISCLAIMER
    I understand that the Facility staff do not diagnose illnesses or prescribe medical treatments. Sauna and cold shower services provided are not medical in nature and are not a substitute for professional medical advice or treatment. I affirm that I have consulted a physician regarding the use of saunas and cold showers and have disclosed any relevant health conditions. I understand that I am responsible for informing staff of any changes to my health. The Released Parties are not liable for my failure to do so.

    3. ACKNOWLEDGEMENT OF RISK
    I understand and acknowledge that the use of sauna and cold shower facilities carries inherent risks that cannot be eliminated, regardless of the care taken. I confirm that my participation is voluntary and that I assume all such risks.

    Minor Risks:

    Skin irritation, allergic reactions, minor burns, cold sensitivity, dizziness, or dehydration.
    Major Risks:

    Heat exhaustion, heat stroke, heart complications, fainting, cold shock, loss of consciousness, personal injury, or death.
    4. FORCE MAJEURE
    If a force majeure event prevents performance of this agreement, the affected party shall notify the other party as soon as reasonably possible. Proof of such an event must be submitted after the event concludes to avoid liability.

    5. DESCRIPTION OF SERVICES

    Oyama Public Sauna provides a traditional hot sauna experience and related amenities, including:

    Access to the public sauna
    Cold shower
    Relaxation area
    Please note: We strive to represent our services accurately, but we do not guarantee that all website images and descriptions are current or exact.

    6. CONDITIONS AND CAUTIONS FOR USE
    Health Cautions
    Sauna and cold shower use are not recommended for individuals with:

    Pregnancy
    Heart or circulatory conditions
    Fever or infection
    Acute injuries (especially those with swelling)
    Peripheral or diabetic neuropathy
    Raynaud’s syndrome
    Cold urticaria
    Those on medications affecting blood pressure, heart rate, or heat tolerance
    Dehydration (e.g., from hangovers)
    Elderly persons who may have reduced heat regulation
    Always consult your physician if using prescription medications or if you have any underlying health conditions.

    Safety Hazards
    Be aware of the following potential risks:

    High temperatures and hot surfaces in the sauna
    Sudden temperature changes due to cold shower use
    Slippery surfaces (wood, turf, pavement, and shower area)
    Smoke and fire hazards from the wood stove
    Insect stings or bites
    If using the cold shower, please exercise caution. Cold water exposure may lead to temporary discomfort, dizziness, shortness of breath, or cold shock, especially for individuals with cardiovascular or respiratory issues.

    7. RULES AND RECOMMENDATIONS FOR USE
    Maximum 5 people allowed in the sauna at a time
    No food or drinks except water permitted inside the sauna
    No glass - water bottles must be metal or plastic
    Footwear must be worn at all times on turf or pavement and removed before entering the sauna
    This is a self-guided experience – staff do not monitor your cycle time or tolerance for heat or cold
    Recommended Use:
    If you are new to sauna and/or cold therapy, begin with short intervals (e.g., 5–10 minutes in the sauna, followed by a brief cold shower of 5–30 seconds). Always rest and hydrate between cycles. If you feel unwell, light-headed, or uncomfortable at any point, stop immediately and rest.

    8. PAYMENT, BOOKINGS & CANCELLATIONS
    Payment and Bookings
    Payment via credit card or E-transfer through Oyama Public Sauna booking platform
    Payments can be made as cash on location prior to event
    Invoice issued via E-mail or paper
    Cancellations & Modifications
    No refunds
    Bookings cannot be modified within 24 hours of session time
    Private bookings cancelled within 48 hours are subject to a 50% charge
    Late Arrival Policy
    Doors open 5 minutes before and close 5 minutes after your scheduled time. Late arrival may result in forfeited access.

    9. WARRANTY AND LIABILITY LIMITATION
    To the fullest extent permitted by law, Oyama Public Sauna provides all products and services “as is” and makes no warranties regarding their fitness for a particular purpose. Liability is limited to the amount paid for the service or product in question, and only in cases of gross negligence or willful misconduct.

    10. GOVERNING LAW AND JURISDICTION
    These terms are governed by the laws of British Columbia, and any disputes will be resolved in the Kelowna courts.

    11. GENERAL LIABILITY
    Oyama Public Sauna is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of revenue, profit, or opportunity, even if such damages were foreseeable.

    12. PARKING & USE OF NEARBY LAKES
    Parking:
    Guests park at or near the Facility entirely at their own risk. Woodland Saunas Inc., doing business as Oyama Public Sauna, is not responsible for any theft, damage, towing, or loss that may occur to vehicles or their contents while parked on or near the premises.

    Lake Use Disclaimer:
    Swimming or entering Kalamalka Lake or Wood Lake is not a service provided or supervised by Woodland Saunas Inc. Any use of the lakes is undertaken solely at the customer’s personal discretion and risk. Woodland Saunas Inc. assumes no responsibility or liability for any incidents, injuries, illness, drowning, or other outcomes resulting from lake use. By signing this waiver, the customer acknowledges and accepts all risks associated with lake use and agrees that they are acting entirely of their own accord.

    13. SEVERABILITY

    If any provision of this agreement is found unenforceable or invalid, all remaining provisions shall remain in full force and effect.

    14. UPDATES TO TERMS
    Oyama Public Sauna reserves the right to update or modify this waiver at any time without prior notice. Continued participation indicates acceptance of any updated terms.

    ACKNOWLEDGEMENT AND SIGNATURE
    I have read and fully understood the terms of this waiver and release. I voluntarily agree to the conditions stated above and confirm that I am of legal age to sign this agreement.
