COBALT BASEBALL – WAIVER OF LIABILITY & RELEASE AGREEMENT
Participation in baseball training, practices, and games through COBALT Baseball and COBALT Athlete (GT Fitness, Inc. d.b.a. COBALT Fitness) involves inherent risks of injury. By completing this registration, I, the undersigned participant (or parent/guardian if the participant is under 18), acknowledge and agree to the following terms:
1. Assumption of Risk:
I understand that baseball activities carry the risk of injury, including but not limited to muscle strains, broken bones, illness, paralysis, or death. I voluntarily assume full responsibility for all such risks arising from participation in any COBALT Baseball or COBALT Athlete activity.
2. Release of Liability:
I hereby release, waive, and hold harmless COBALT Baseball, COBALT Athlete, its owners, coaches, staff, and facilities from any and all claims, causes of action, or liability for personal injury, illness, property damage, or wrongful death, whether arising from negligence or otherwise, that may occur during or result from participation.
3. Indemnification:
I agree to defend and indemnify the above RELEASEES against any claims made by or on behalf of the participant or any third party arising out of participation in COBALT activities, including all costs and attorney’s fees incurred in such defense.
4. Participant Responsibility:
I agree to inspect all facilities and equipment prior to participation and immediately report any unsafe conditions. I understand that helmets must be worn during batting cage, tee work, and soft toss activities. I am financially responsible for any medical care needed due to injury during participation, and my personal health insurance will be the primary coverage.
5. Program Terms:
I understand that all payments are non-refundable, and all sessions are use-it-or-lose-it, expiring automatically at the conclusion of the registered program. No credits, transfers, or make-ups will be issued after the program ends.
6. Media Consent:
I grant permission to COBALT Baseball and COBALT Athlete to capture, edit, and use photographs or video recordings of the participant in connection with training, practices, or events for promotional, educational, and social media purposes. I understand that no compensation will be provided, and that all images and recordings remain the property of COBALT Baseball.
7. Acknowledgment:
By signing below, I confirm that I have read and fully understand this waiver and release agreement, that I am voluntarily agreeing to its terms, and that I am aware of the risks involved in COBALT Baseball activities.
