I, the undersigned, being of legal age and sound mind, do hereby acknowledge and agree to the following terms and conditions:
1.Assumption of Risk: I acknowledge that participation in the event/activity involves inherent risks. Being aware of my own health and physical condition, and having knowledge that my participation in any event/activity may be injurious to my health, I am voluntarily participating in the event/activity, and I voluntarily assume all such risks, known and unknown, associated with my participation in this event/activity.
2.Release and Waiver: To the fullest extent permitted by applicable law, I hereby release, discharge, and hold harmless United American Indian Involvement (UAII) its officers, directors, employees, agents, and volunteers (collectively, the "Releasees") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by me or to any property belonging to me while participating in the event/activity, including but not limited to any claims arising from the negligence of the Releasees. I hereby waive all rights under California Civil Code section 1542, which reads: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
3.Indemnification: I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost, including reasonable attorneys' fees, that may incur due to my participation in the event/activity.
4.Medical Treatment: In the event of an emergency, I consent to receive medical treatment deemed necessary by medical professionals. I understand that I am responsible for any medical expenses incurred.
5.Photographic Release: I grant permission to the Releasees to use any photographs, videos, or recordings of me taken during the event/activity for promotional purposes without compensation.
6.Severability: If any provision of this waiver is found to be unenforceable, the remaining terms shall remain in full force and effect.
7.Governing Law: This waiver shall be governed by and construed in accordance with the laws of the state of California.
