RELEASE OF ALL CLAIMS, WAIVER OF LIABILITY, ACCEPTANCE OF INHERENT RISKS, AND INDEMNITY AGREEMENT

To: Michael and Kellie Vogt and Vogt Ranch, LLC

The undersigned ("Participant") acknowledges that they have been invited to visit and participate in activities at the property commonly referred to as Vogt Ranch, located at 11975 Cochera Via Drive, Dulzura, CA 91917 (the "Ranch" Participant understands that the Ranch contains numerous inherent risks and hazards which could result in bodily injury, death, or damage/loss to personal property. These include, but are not limited to: rustic and uneven terrain; domesticated animals; wild animals that may enter the property; orchard and other trees posing collision hazards; natural and man-made obstacles; and motorized and non-motorized equipment or vehicles. Activities at the Ranch- including but not limited to motorcycle or ATV riding, shooting, horseback riding, horseshoe pitching, hiking, exposure to sun or weather, feeding animals, and other recreational pursuits-carry significant inherent risks of injury

1. INSPECTION AND SAFETY:

Participant agrees to inspect all facilities, trails, and equipment to be used prior to engaging in any activity at the Ranch. If any condition is believed to be unsafe, Participant shall immediately advise Ranch staff or the property owners and refuse to participate until the condition is corrected.

2. UNDERSTANDING OF RISKS:

(a) Participant fully understands and acknowledges that activities at the Ranch may result in bodily injury, partial or total disability, paralysis, or death. (b) The social and economic losses or damages resulting from such injuries may be severe. (c) Such risks may result from the action, inaction, or negligence of the Participant, of others, or of the "Releasees" named below. (d) There may be other risks not known or reasonably foreseeable at this time.

3. ASSUMPTION OF RISK:

Participant voluntarily accepts and assumes all risks of loss, damage, injury, disability, paralysis, or death, however caused and whether caused in whole or in part by the negligence of the Releasees named below.

4. RELEASE AND COVENANT NOT TO SUE:

In consideration for being permitted to enter upon and use the Ranch and its amenities, Participant hereby waives, releases, and discharges Michael and Kellie Vogt, Vogt Ranch, LLC, and all of their agents, employees, officers, directors, members, and representatives (collectively, the "Releasees") from any and all claims, demands, actions, causes of action, or liabilities of any kind, whether known or unknown, arising out of or related to participation in activities on the Ranch, including claims for personal injury, death, or property damage, even if caused in whole or in part by the negligence of the Releasees.

5. INDEMNIFICATION:

Participant agrees to indemnify, defend, and hold harmless the Releasees from any and all loss, liability, damage, or cost that may be incurred due to their presence on the Ranch or participation in any activity, whether caused by negligence or otherwise.

6. ACKNOWLEDGMENT OF DANGEROUS ACTIVITIES:

Participant expressly acknowledges and agrees that activities at the Ranch-including but not limited to motorsport and equestrian activities-are inherently dangerous and involve substantial risk of serious injury, death, or property damage. Participant hereby assumes full responsibility for and risk of such injuries or damages while participating in any activity at or associated with the Ranch.

WAIVER OF CALIFORNIA CIVIL CODE SECTION 1542

Participant expressly waives the protections of California Civil Code $1542, which provides:

"A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor."

GENERAL TERMS

This release and waiver is intended to be as broad and inclusive as permitted by law. If any portion is held invalid, the remainder shall remain in full force and effect. Participant acknowledges that they have carefully read and fully understand this document, are not relying on any oral or written statements of the Releasees, and are signing it voluntarily and of their own free will.

In consideration of {typeA} ("Minor") being permitted by the Releasees to participate in activities and to use the Ranch's equipment and facilities, I further agree to indemnify and hold harmless the Releasees from any and all claims brought by or on behalf of the Minor, and which are in any way connected with such participation or use by the Minor.
