ANNUAL VOLUNTEER RELEASE, WAIVER & DISCLAIMER OF LIABILITY (“Release”)
IN CONSIDERATION for use of the premises and participation as a volunteer at various events between ______November_____________, 2025___ and ______________November _________, 2026_____(collectively, the “Events”) located in the Wellen Park community, Sarasota County, Florida, (the “Property") the undersigned (the “Releasor”) and for other good and valuable considerations, the receipt and sufficiency of which are hereby acknowledged by the Releasor from or on behalf of Wellen Park, LLLP, Main Street Ranchlands, LLLP, West Villages Improvement District (collectively, “WELLEN”), the Releasor does hereby release, waive, disclaim and forever discharge WELLEN and all of its respective partners, affiliates and subsidiaries and their respective partners, directors, officers, agents, administrators, staff, employees, shareholders, members, associates, personal representatives, successors, and assigns (collectively, the “Releasees”), of and from all, and all manner of action and actions, cause and causes of action, suits, torts, damages, judgments, executions, claims, demands, strict liability, breach of duties, negligence, personal injuries, warranties, representations, defects in workmanship, product liability, violations of state and federal law, claims and demands whatsoever, in law or in equity, which the Releasor ever had, now has, or may have, or which the Releasor or the Releasor’s personal representatives, successors, heirs or assigns, hereafter can, shall or may have, against any or all of the Releasees for any matter whatsoever, from the beginning of time to the day of these presents, and further release, satisfy and forever discharge and hold harmless the Releasees, individually and collectively, from any or all of the above which may arise, result, occur or obtain subsequent to the day of these presents arising out of any act or omission by any or all of the Releasees, or otherwise, and relating to, among other things, the Events and the participation in the Events by the Releasor.
The Releasor acknowledges having been informed that participation in the Events involve a risk of injury and even death and that the Releasor is voluntarily participating in the Events with knowledge of the dangers and risks involved. Releasor acknowledges that Releasor may be required to, in addition to other activities, direct traffic, move furniture, and/or lift items that may weigh up to fifty (50) pounds. Releasor hereby represents Releasor has consulted with a physician regarding any health implications to the Releasor as a result of participating in Events and has been advised by said physician that Releasor may participate in the Events. Releasor, on behalf of the Releasor and the Releasor’s personal representatives, successors, heirs or assigns acknowledges that there are risks, known and unknown, associated with the participation in the Events and that the Releasor hereby expressly, knowingly and freely AGREES TO COMPLETELY AND ABSOLUTELY ASSUME ALL RISKS enumerated or referred to herein AND FULL RESPONSIBILITY FOR any and all personal injuries, accidents, damage, losses or illnesses, including death, loss of personal property which may occur, directly or indirectly, while using or as a result of having participating in any and/or all of the Events and further agrees to hold Releasees harmless from any and all claims relating to the Events and/or the participation therein.
This Release shall be governed and construed in accordance with the laws of the State of Florida. In the event of any litigation concerning or arising out of this Release, the prevailing party shall be entitled to recover all reasonable attorney's fees and costs from the non-prevailing party. Exclusive jurisdiction and venue for all litigation related to or arising from this Release shall lie in the state courts having jurisdiction over Sarasota County, Florida.
I, THE RELEASOR, HAVE READ THE FOREGOING ACKNOWLEDGMENT OF RISK, ASSUMPTION OF RISK AND RESPONSIBILITY AND RELEASE OF LIABILITY. I UNDERSTAND THAT, BY SIGNING THIS DOCUMENT, I MAY BE WAIVING VALUABLE LEGAL RIGHTS. By signing this Agreement, I acknowledge that I fully understand and appreciate the words and terms of this Agreement, that I sign this Agreement voluntarily as my own free agent, and that I have not relied upon any statements or promises of any persons other than those contained in this Agreement I ACKNOWLEDGE AND SWEAR THAT I HAVE REACHED THE AGE OF MAJORITY AND, THEREFORE, AM ABLE TO ENTER INTO THIS RELEASE. I HAVE READ AND UNDERSTOOD THE ABOVE AND I HEREBY EXECUTE SUCH DOCUMENT ON THE DATE BELOW. IN ADDITION I HEREBY AGREE TO THE FOLLOWING TERMS:
1. I am 18 years or older.
2. I will wear appropriate attire and shoes that are suitable for all Events.
3. I will exercise due care in participating in physical activity and will stop or rest when necessary to prevent injury.
4. Disruptive, illegal or inappropriate behavior, abuse of the Property, failure to abide by the terms of this Release or applicable rules and regulations, or any other action by or on behalf of Releasor deemed not to be in the best interests of the Property shall be grounds for Releasees to require Releasor to leave the Property.
