1. Scope of Inspection
The inspection is a non-invasive, visual examination of the readily accessible systems and components of the property. It is intended to identify material defects observed on the date of the inspection. The inspection will be conducted in accordance with the InterNACHI Standards of Practice and Code of Ethics, a copy of which is available at www.nachi.org/sopAttachment.png. The inspection is not a building code inspection and does not include any destructive testing, dismantling, or evaluation of concealed components.
2. Limitations
The inspection and report are not technically exhaustive and do not include: Prediction of future conditions or life expectancy of systems or materials. Evaluation of cosmetic or aesthetic issues. Environmental testing (radon, mold, asbestos, lead, etc.) unless specifically contracted as an additional service. Engineering, architectural, or structural analysis. The inspection represents the condition of the property at the time of the inspection only.
3. Client Responsibilities
The client understands that it is their responsibility to: Ensure all utilities (electric, gas, water) are on at the time of inspection. Provide full access to the property, including basements, crawlspaces, attics, and garages. Review the inspection report in its entirety and seek licensed specialists for further evaluation where recommended.
4. Liability Limitation
The client agrees that Fresh Coast Inspections LLC’s total liability for any and all claims, damages, or losses arising out of this inspection and report, regardless of legal theory, shall be limited to the total fee paid for the inspection. The client waives all claims for consequential, exemplary, or incidental damages. Any claim must be made in writing within one (1) year of the inspection date.
5. Ownership of Report
The inspection report is the exclusive property of the client named above and is prepared solely for their use. Fresh Coast Inspections LLC does not assume any duty, liability, or responsibility to third parties who obtain the report without written consent.
6. Dispute Resolution
Any dispute arising from this agreement shall first be submitted to mediation in Muskegon County, Michigan before any legal proceedings are initiated. Each party shall bear their own costs.
7. Payment & Fees
Inspection fees are due in full upon completion of the inspection, unless otherwise arranged in writing. Failure to remit payment may result in withholding of the inspection report. Returned checks or failed payments are subject to a $35 processing fee.
8. Entire Agreement
This document contains the entire agreement between Fresh Coast Inspections LLC and the client. No oral statements or promises shall modify these terms unless made in writing and signed by both parties.
