4. Session Requirements:
- Check-in: All participants must check in at the Admissions Office upon arrival together with the photographer
- Scheduling Changes: Any changes to date or time must be requested at least 24 hours in advance, subject to availability
- Cancellation: Client may cancel with 24-hour notice. Fee can be applied to a photo session on another date or refunded at request.
5. Client and Photographer Responsibilities:
- Arrive promptly at scheduled session time
- Respect garden facilities, plants, and decorations
- Be considerate to other garden visitors Follow all BGO policies and staff instructions
- Photographer must maintain professional conduct and liability insurance
- No movement of BGO benches, decorations, or plants
- No smoking/vaping of any kind is permitted in or on the premises
6. Photography Guidelines:
- Photography is permitted in designated garden areas only
- Drones are prohibited unless pre-approved by BGO and FAA
- No climbing on structures, benches, or landscape features
- Sparklers, confetti, and open flames are prohibited
- BGO reserves the right to use photographs taken at the garden for marketing purposes
7. Media Release and Gallery Sharing:
- Media Release: Client and all session participants grant BGO permission to use any photographs taken during this session for BGO's advertising, marketing, and promotional purposes, including website and social media use
- Gallery Requirement: Photographer agrees to provide BGO with the complete edited gallery from this session within thirty (30) days of the session date
- Delivery Method: Gallery may be delivered via digital download link, cloud sharing service, or USB drive
- Usage Rights: While BGO may use images for marketing purposes, photographer retains full copyright and commercial rights to all photographs
- Photo Credit: BGO will provide appropriate photographer credit when using images for marketing purposes
8. Liability and Indemnification:
Client agrees that BGO shall not be liable for damages, loss, or injury to persons or property during the photography session. Client agrees to indemnify and hold harmless BGO, its officers, agents, and employees from any claims arising from the photography session.
9. Weather Policy:
Photography sessions are weather-dependent. In case of inclement weather, Client will contact the BGO to discuss rescheduling options.
10. Entire Agreement:
This writing reflects the entire agreement between Client and BGO. Any modifications must be in writing and signed by both parties.
By signing below, both parties acknowledge and agree to the terms and conditions outlined in this Photography Permit Agreement.
