This agreement is made between the Pacific & Asian Affairs Council (hereinafter referred to as "PAAC") and the undersigned student (hereinafter referred to as "Student") and the Student's parent(s)/guardian(s):
STUDENT AND STUDENT'S PARENT(S)/GUARDIAN(S) UNDERSTAND AND AGREE THAT:
- When Students register for a PAAC event (be it a workshop, summit, etc.), the choice of transportation (when provided), schedule of activities and functions, choice of accommodations, and meals are under the direction of PAAC staff;
- When Students travel to and from program events on their own, unless PAAC makes bus or airline arrangements on behalf of the Student, the Student and their parents/guardians are responsible for the Student’s transportation to the Student’s home airport or bus meeting point;
- If your Student is attending a PAAC event that requires board and lodging, PAAC staff will determine all boarding and lodging arrangements for the Students during their stay and reserves the right to modify or change such arrangements whenever they consider it to be in the best interests of the Students and PAAC’s program;
- PAAC staff will make use, at their discretion, of public and private transportation for all instructional and extracurricular travel and will communicate this directly with Students and parents/guardians;
- PAAC does not represent or act as an agent for, and cannot control the acts or omissions of, boarding and lodging providers, transportation carriers, tour organizers, or other providers of food, goods or services, and PAAC is not responsible for matters that are beyond its control;
- The use of any drug, including cigarettes and alcohol, violates PAAC policy and is a serious offense, which may involve the early termination of the Student’s participation in the program, and the early return to home at the Student’s expense;
- PAAC staff shall have the right to (i) establish reasonable rules, standards of conduct and instructions for dress and behavior for the Students (which shall include PAAC policies governing Student conduct), (ii) enforce such rules, standards of conduct and instructions, and (iii) terminate Student’s participation in the program due to any violation of such rules, standards of conduct and instructions;
- PAAC staff may request to send home, at any time during the term of the program, any Student whose conduct warrants such action or whose state of health, as determined by medical opinion, renders continued participation inadvisable. It is agreed that (i) any additional expense arising from an earlier return to home will be borne by the Student; and (ii) there shall be no refund of any sums that may have been paid by the Student;
- PAAC does not assume responsibility for the loss or theft of any personal property of the Student;
- The Student is responsible for exercising caution and common sense at all times to avoid situations that could lead to injury to the Student or members of the group;
- The Student understands that the Student is responsible for any damage the Student may cause to property, and the Student agrees to pay for any such damage and not hold PAAC, its board of governors, directors, staff and members, PAAC’s agents or contractors, the Student’s school, and any person accompanying the group responsible;
- The Student will complete follow-up paperwork, such as an evaluation form;
- Any part of the Student’s journals, blogs, and/or evaluation may be used in future PAAC publications and promotional materials (anonymously, if requested by the Student); the Student will complete follow-up paperwork such as an evaluation form;
- The Student certifies that the Student is in good physical and mental health, has no special or medical or physical conditions that have not been disclosed to PAAC staff, nor any special needs or requirements, which would impede participation in the program, nor be of any harm or inconvenience to the Student or the other participants;
- If required by PAAC staff, participation in the program is subject to medical clearance by a licensed physician;
- The laws of the State of Hawaiʻi shall govern the interpretation of the terms of this agreement. If any portion of this agreement is held to be invalid, the remainder of the agreement shall remain in full force and effect.
RELEASE, HOLD HARMLESS and INDEMNITY
In consideration of the benefits derived from the program, Student voluntarily releases PAAC, its board of governors, directors, officers, employees, agents, representatives and chaperones, and the PAAC staff, from any and all claims, liability, causes of action, costs and expenses (including, but not limited to, claims for loss or damage to Student’s property and for illness, injury or other risks), which may arise out of or that are incident to Student’s participation in the program. Student further agrees to indemnify, defend, and hold harmless PAAC, its board of governors, directors, officers, employees, agents, representatives, and chaperones, and the PAAC staff from and against any and all claims, liability, causes of action, costs and expenses, of whatsoever nature, which may arise out of or that are incident to the program.
