ARTICIPANT LIABILITY WAIVER AND RELEASE OF CLAIMS
PLEASE READ CAREFULLY BEFORE SIGNING.
By electronically signing this document below, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Participant Liability Waiver and Release on behalf of my child.
Activities Covered:
This waiver applies to all activities organized or operated by TINY TOTS LACROSSE LLC, including but not limited to lacrosse practices, games, camps, clinics, demonstrations, or related events (collectively referred to as “Activities”).
Assumption of Risk:
I, the undersigned parent or legal guardian, acknowledge that participation in youth lacrosse involves inherent risks of injury, including but not limited to collisions, falls, equipment contact, and other participants’ actions. I understand that these risks may result in serious injury, illness, or death, and that such risks cannot be entirely eliminated even with proper supervision and instruction.
I voluntarily choose to allow my child to participate in these Activities, fully assuming all such risks, both known and unknown.
Consent to Participate
I consent to my child participating in lacrosse activities provided by TINY TOTS LACROSSE LLC.
Release of Liability:
In consideration for my child’s participation, I, on behalf of myself, my child, and our heirs, assigns, and representatives, hereby release, discharge, and hold harmless TINY TOTS LACROSSE LLC , its owners, members, coaches, volunteers, employees, and agents from any and all claims, demands, or causes of action arising out of or related to my child’s participation in the Activities.
This release includes claims of negligence, omission, or error by the Organization or its representatives, except where prohibited by law.
Medical Authorization:
In the event of injury or illness, I authorize TINY TOTS LACROSSE LLC and its representatives to obtain emergency medical treatment for my child. I understand that reasonable efforts will be made to contact me prior to such treatment, and that I am solely responsible for any medical expenses incurred.
Participant Conduct:
I understand that my child must follow all safety instructions and rules of conduct established by coaches and staff. I acknowledge that failure to follow such instructions may result in removal from participation without refund.
Electronic Signature and Consent:
By submitting your e-signature below and signing electronically, I acknowledge that I have read and agree to all terms of this Participant Liability Waiver and Release. I certify that I am the parent or legal guardian of the participant and that this electronic signature has the same legal effect as a handwritten signature.
Governing Law:
This agreement is governed by the laws of the State of New York. If any part of this waiver is found unenforceable, the remaining provisions remain in full force and effect.
Refund Policy:
- No refunds of any kind (full or partial) will be issued for any reason for an enrolled participant should they not attend a class that is scheduled and takes place. A make-up class may be offered. Should a participant not attend that makeup class, another makeup class will not be offered. Makeup classes are limited to one per session regardless of the number of regularly scheduled classes that were missed/unattended.
- Full refunds apply when the withdrawal of a student is received in writing 2 weeks prior to the start of any session.
- Should TINY TOTS LACROSSE LLC find it necessary to remove a child from a class, a refund will be issued after deduction for classes already attended.
- There is no refund of the registration fee.
- No refunds will be issued after class 2 of any session.
- Refunds prior to class 2 of any session will be given for the remaining sessions only.
- No refunds will be issued for failure to attend a make-up class.
- All requests for refunds must be made in writing and emailed to a TINY TOTS LACROSSE LLC representative.
- In the event of a natural disaster or worldwide pandemic closure, refunds will not be issued but we will offer credit in some form toward a future TINY TOTS LACROSSE LLC class.
Make-Up Classes & Cancellations:
- We will use indoor space during inclement weather. If there is no indoor space available, we will make up a maximum of two classes due to inclement weather (extreme cold, heat, or rain).
- During the winter season, if your pre-school or center is closed on a day due to snow or other weather-related issues, we will work with your school or center to reschedule up to two cancelled sessions.
- Make up classes may be held on a different day or time than the regularly scheduled class due to potential scheduling conflicts.
- TINY TOTS LACROSSE LLC reserves the right to cancel any program due to insufficient enrollment. Upon cancellation, a full refund will be made.
Telephone, Email & SMS Text Messaging Term and Conditions:
By providing your e-signature you are consenting to receive email, text and or phone communications from TINY TOTS LACROSSE LLC . Message frequency varies.
TINY TOTS LACROSSE LLC does not have a separate charge for these services; however, message and data rates may apply from your mobile carrier for SMS text messages. Subject to the terms and conditions of your mobile carrier, you may receive text messages sent to your mobile phone.
By e-signing you are providing your consent to participate in this program, you approve any such charges from your mobile carrier. Charges for text messages may appear on your mobile phone bill or be deducted from your prepaid balance. TINY TOTS LACROSSE LLC reserves the right to terminate this SMS service, in whole or in part, at any time without notice. The information in any message may be subject to certain time lags and/or delays. You are responsible for managing the types of SMS texts you receive.
To stop receiving text messages, reply STOP, END, CANCEL or UNSUBSCRIBE to a TINY TOTS LACROSSE LLC text message. By enrolling, you consent that following such a request to unsubscribe, you will receive one (1) final message from TINY TOTS LACROSSE LLC confirming that you have been inactivated in our system. Following such confirmation message, no additional text messages will be sent unless you re-activate your subscription.
