Faithful Fastballs Consignment Agreement
By submitting this form, you (the Consignor) agree to the following terms with Pierce Sports & Training LLC (Faithful Fastballs) located at 5325 Enterprise Dr, Paducah, KY 42001:
1. Consignment Split:
Sales proceeds will be divided 60% to the Consignor and 40% to Faithful Fastballs. Sales tax will be collected and remitted by Faithful Fastballs as required by Kentucky law and is not included in your payout percentage.
2. Pricing & Markdown:
Faithful Fastballs reserves the right to price, discount, or markdown items as necessary to facilitate sale, as noted by the Consignor.
3. Consignment Period:
Items will remain on consignemnt for 60 days from the date received unless agreed otherwise. After that period, unsold items may be:
- Picked up by the Consignor within 7 days of notice, or
- Donated to Goodwill
4. Payouts:
Payments for sold items will be issued on or before the 10th day of the following month after the sale occurs, via the payout method indicated on this form.
5.Loss or Damage
Faithful Fastballs will take reasonable care of all items but is not responsible for theft, fire, flood, or damage beyond its control.
6. Ownership
Consignor certifies that they are the rightful owner of all items and have full authority to sell them.
7. Abandoned Accounts:
Consignors must keep current contact and payment information on file. Unclaimed payouts atfer 6 months may be forfeited and handled in accordance with Kentucky unclaimed property laws.
8. Acknowledgement:
The Consignor understands and agrees to all terms stated herein.
