Journey & Friends Fitness

I grant Mommy’s Journey and Journey & Friends Resource Center permission to photograph, film, and record my performance/participation at this event, and to use my name, likeness, and recordings for promotional, educational, and fundraising purposes without compensation. For minors, first name only may be used.

I understand that participation is voluntary.

1) Assumption of Risk (activities & facilities).
I understand that fitness and movement activities—including classes, open gym, circuits, adaptive movement, and use of equipment on or off site—carry inherent risks (e.g., falls, strains, cardiac events, allergic reactions, exposure to communicable diseases, equipment malfunction, and ordinary hazards). I voluntarily choose to participate and accept these risks for myself and, if applicable, for the Minor(s) named above.

2) Release of Liability for Ordinary Negligence (California).
To the fullest extent permitted by California law, I release and discharge Journey & Friends Fitness, Mommy’s Journey, their owners, officers, directors, employees, contractors, volunteers, agents, landlords, affiliates, and insurers (together, the “Released Parties”) from any and all claims, demands, or causes of action for injury, illness, property damage, or death arising from ordinary negligence by any Released Party. This release does not apply to gross negligence, willful or wanton misconduct, or unlawful acts.
Notice re: Minors in California: Enforceability of pre-injury releases for minors can be limited under California law. Regardless of any limitation on a minor’s release, the indemnification below applies.

3) Indemnification / Hold Harmless.
I agree to defend, indemnify, and hold harmless the Released Parties from and against any claim, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising out of or related to my (and/or the Minor’s) participation, except to the extent caused by a Released Party’s gross negligence or willful misconduct.

4) Health Status & Rules.
I certify (for myself and/or the Minor) that we are physically able to participate, have disclosed relevant medical/behavioral conditions and needed accommodations, will follow all posted rules and staff instructions, and will not participate when ill or febrile. I understand staff are not medical providers.

5) Emergency Care & Costs.
I authorize the Released Parties to obtain emergency medical care for me and/or the Minor if needed and accept full financial responsibility for all related costs.

6) Communicable Disease & Hygiene.
I acknowledge that sanitizing measures reduce but cannot eliminate infectious-disease risks. I/we will use closed-toe shoes, appropriate attire, and follow hygiene protocols.

7) Severability; Entire Agreement; Updates.
If any provision is held invalid, the remainder remains enforceable. This document is the entire agreement regarding assumption of risk, release, and indemnity, and supersedes prior understandings. Policies and rules may be updated and posted.

8) Governing Law & Venue.
California law governs. Venue/jurisdiction: Orange County, California.

I am the parent/guardian of the participant and consent to their participation under the above terms.
