PLEASE READ THIS DOCUMENT CAREFULLY. BY SIGNING, YOU WAIVE SUBSTANTIAL LEGAL RIGHTS.
In consideration of the opportunity to enter the facility of Pack Leaders Rescue of CT, Inc. ("PLRCT") and interact with or view rescue dogs and other animals for the purpose of potential adoption, the undersigned Visitor (hereinafter "I" or "The Undersigned") agrees to the following terms and conditions:
1. Acknowledgment of Risk and CT Animal Laws
I acknowledge that dogs are playful, can be unpredictable, and may react suddenly due to stress or excitement. I understand that viewing and interacting with animals at PLRCT carries an inherent risk of injury. This includes, but is not limited to, the possibility that dogs may:
- Jump, scratch, or knock down individuals, including children.
- Nip or even bite individuals, including children.
- Cause injuries resulting from tripping, slipping, or falling.
I understand that Connecticut General Statutes § 22-357 imposes strict liability on dog owners for damages done by their dogs, and I am assuming all risks inherent in the animal viewing process.
2. Assumption of Risk and Waiver of Liability
I HEREBY EXPRESSLY AND VOLUNTARILY ASSUME ALL RISKS of injury, death, property damage, and loss associated with my visit and interaction with any animals or premises, whether known or unknown, and regardless of the cause.
I, for myself and my heirs, executors, and administrators, HEREBY WAIVE, RELEASE, AND FOREVER DISCHARGE PLRCT, its officers, directors, volunteers, agents, employees, and property owners (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury (including severe injury or death) that may be sustained by me or any minor child/dependent, REGARDLESS OF THE CAUSE, INCLUDING ANY CLAIM BASED ON THE NEGLIGENCE OR FAULT OF THE RELEASED PARTIES.
3. Indemnification and Hold Harmless
I agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost, including reasonable attorney's fees, that may incur due to my presence at the facility or interaction with the animals, whether caused by my negligence or otherwise. This indemnification specifically extends to any claim brought by any minor child or dependent accompanying me.
4. Visitor Conduct and Rules
- I certify that I will immediately follow all instructions and rules provided by PLRCT staff and volunteers.
- I understand that any physical interaction with dogs must be supervised and expressly authorized by PLRCT staff.
- I certify that any children or dependents accompanying me are under my direct and constant supervision and will not approach any animal without explicit permission and supervision.
