Permanent Jewelry Application and Release Waiver

This Permanent Jewelry Application and Release Waiver (the "Waiver") is a binding legal agreement between the undersigned Client (hereinafter referred to as "I" or "Client") and Luna Linked (hereinafter referred to as "Artist" or "Studio") for the application of permanent, custom-fit jewelry (the "Service").

I understand that the Service involves custom-sizing a piece of precious metal jewelry (e.g., bracelet, anklet, necklace) and then using a quick, controlled welding process to fuse the two ends together. This process is intended to create a seamless piece of jewelry that does not have a clasp, making it "permanent" or long-lasting until it is intentionally removed or breaks.

I certify that I am over the age of eighteen (18) or have the express written consent and physical presence of a parent or legal guardian.

If I have a known metal allergy, I understand that the Artist cannot guarantee that I will not experience a reaction, and I proceed at my own risk.

I understand and acknowledge the following risks associated with the permanent jewelry application:Temporary Discomfort:I may feel a brief, mild heat or spark sensation near the welding site, although the Artist will take precautions to protect my skin.Irremovability:The jewelry is permanent and cannot be easily removed without cutting. I understand that I may need to cut the jewelry off for security purposes (e.g., airport security, MRI scans, medical procedures) or due to personal preference, and the Artist is not responsible for the cost of re-welding.Jewelry Loss/Breakage:I understand that despite being welded, the jewelry is delicate and may break, snag, stretch, or be lost due to accident, force, wear and tear, or natural causes. The Studio is not responsible for replacement or repair if the jewelry is lost or broken outside of a limited warranty period (one free reweld if needed).Skin Irritation/Allergic Reaction:Despite precautions, rare instances of skin irritation or allergic reactions to the metal may occur.

In consideration of receiving the Service, I hereby release, waive, discharge, and covenant not to sue Luna Linked, its owners, employees, agents, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while receiving the Service, or at any time thereafter, including, but not limited to, the risks outlined in Section 3.I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including attorney's fees, that they may incur due to my participation in the Service, whether caused by my negligence or otherwise.

I have received and understand the aftercare instructions, which include:Keep the area clean. Cleaning cloth provided.Avoid excessive pulling or snagging the jewelry.The jewelry may need to be removed for certain medical procedures (e.g., X-rays, MRI) or sporting events.I understand that failure to follow these instructions may result in breakage, loss, or damage to the jewelry, for which Luna Linked is not responsible.

I have read this Waiver carefully, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I enter into this agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
