We must process personal data (including sensitive personal data) so that we can provide these services – in doing so we act as a data controller. You consent to your personal data being included on a computerised database and consent to us transferring your personal details to our clients.

    We may check the information collected, with third parties or with other information held by us.

    We may also pass or pass to certain third parties information to prevent or detect crime, to protect public funds or in other ways permitted or required by law. Please see our privacy statement.

    WORKING TIME REGULATIONS 1998 – OPT OUT OF 48 HOUR WORKING AGREEMENT

                  1.           In the assignment the following definitions will apply:

    “ASSIGNMENT” means the period during which the WORKER is engaged to render services to the CLIENT

    “CLIENT” means the person, firm or corporation by engaging the services of the WORKER.

    “TEMPORARY BUSINESS” means WESTMID SERVICES EMPLOYMENT AGENCY.

                  2.           The Working Time Regulations 1998 provide that the average weekly Working time cannot exceed 48 hours over a 17-week reference period.

                  3.           RESTRICTION: The Working Time Regulations provide that the Working Time shall not work on an Assignment with the client in excess of the Working Week unless he/she agrees in writing that this limit should not apply.

                  4.           CONSENT: The Temporary Worker hereby agrees that the Working Week limit shall not apply to this nor any other Assignment.

                  5.           WITHDRAWAL OF CONSENT – (4.1) The Temporary Worker may end this Agreement by giving Westmid Services Employment 7 days’ notice in writing. (4.2) For the avoidance of any doubt, any notice bringing this agreement to an end shall not be construed as termination by the Temporary Worker of an Assignment with a Client. (4.3) Upon the expiry of the notice period, the Working Week limit shall apply with immediate effect. This agreement is governed by the law of England & Wales and is subject to the exclusive jurisdiction of the Courts of England & Wales.

     

    HOLIDAY PAY FOR TEMPORARY STAFF – WESTMID SERVICES EMPLOYMENT AGENCY LTD

    Annual Leave Year runs from your “Commencement Date” until “Termination Date” (up to a max of 12mths)

    All members of Temporary Staff are entitled to receive paid Annual Leave pro-rata over a period of 12 months (including bank holidays) from the 1st day of employment. Annual Leave is accrued at a rate of 0.6 days per week.

    Booking Paid Holiday – All members of Temporary Staff MUST give Westmid Services Employment Agency notice (in writing) of their intention to take paid holiday that is at least twice as long as the period of leave which they wish to take. Holiday can ONLY be booked on Monday, Thursday, or Friday. It is also the candidate’s responsibility to ensure that the ALL Annual Leave accrued before 1st May, (and not taken before then) has been taken by 30th April (except for statutory holiday pay)

    Temporary Staff will only be entitled to be PAID Holiday which has been accrued at the time I submit the paid leave. Payments for annual leave will be calculated in accordance with & in proportion to the number of basic hours worked in the previous 52 weeks.

    PERMISSION TO WORK IN THE UK – In the interest of compliance and the prevention of illegal working we will need to verify and take a copy of your original ID documents before confirming your right to work in the UK.

     

    CONSENT DECLARATION

    I, hereby give my consent to Westmid Services Employment to process the following information:

    Personal data – Name; Date of Birth; Contact Details (telephone numbers, email, and postal address); Experience; Training & Qualifications; CV; NI Number; RTW Documents.

    Sensitive Data – Disability/Health information relevant to the role; Criminal Convictions, Photo ID, Biometrics, Bank Details, Equal Ops Data.

    This consent is for the purposes of providing me with work finding services:

    To establish my suitability for the assignments;

    To keep copies of the information I have provided to share with the client(s) to provide me with work-finding services.

    I understand that my consent is required for Westmid Services Employment (including by Zeel/Tempaid/ I Linear / Legal-Sign) to provide me with work-finding services.

    I understand that I have the right to withdraw my consent at any time by contacting The Company.

    I also understand that if I withdraw my consent it may affect the work-finding services The Company are able to provide to me.

    I also declare that The Company will only retain my consent for 12 years from the date withdrawn.

    I also declare that I have to right to request The Company to erase, restrict and correct my personal data that I wish to do so.

    I have read and understood The Company’s Privacy Notice (please find attached to Welcome Email)

    EQ OPS: I give my consent to Westmid Services Employment to collect and use my Equal opportunity data (to include but is not limited to) in line with my Registration Details (for monitoring purposes).

    I declare that I have understood WESTMID SERVICES EMPLOYMENT Also Read all the Additional Registration forms.

    I also declare that under the Working Time Regulations I cannot carry Holiday Pay forward from one Annual Leave Year to the next, and can be paid in lieu for any outstanding holiday.

    Consent to opt-out of the 48 hour Working Week Agreement, and if further working week limit that requires 7 days’ notice, in writing, to the Agency to withdraw the consent.

    I consent to Westmid Services gathering and sharing the contents. I consent to my personal data and CV being forwarded to clients. I consent to references being obtained & passed onto potential employers. I give consent to Westmid Services to process my personal & sensitive data. I give consent to receive communication via email; Invoice via telephone, text and email.

    If, during the course of a temporary assignment, the client wishes to employ me directly, I acknowledge that Westmid Services Employment will be entitled to either charge the client a fee or to agree an extension of the hiring period with the Client (after which I may be employed by the Client without further charge being applicable to the Client).
