YOUR ACKNOWLEDGEMENTS AND ASSUMPTION OF RISK
You understand and acknowledge that:
1. during such times that you enter the facility or participate in an activity with the Trainer, that you are doing so at your own risk;
2. the risk of injury from using fitness equipment and participating in activities is significant, including but not limited to muscle soreness, sprains, strains, and in rare cases, more serious injuries such as heart attack, stroke, or death. You knowingly and freely assume all such risks.
3. the Trainer is not liable for defects in equipment provided by third parties, except where the Trainer has failed to take reasonable care in inspecting or maintaining the equipment;
4. to the extent permitted by law, the Trainer will not be held liable for any personal injury, damage to or loss of belongings, or other harm suffered by you during or as a result of the training sessions, except where such injury or harm arises from the Trainer's negligence or failure to take reasonable care
5. during times when you are unsupervised in a training session, you are responsible for your own safety and assume all risks associated with using any exercise equipment or engaging in physical activity, except where such unsupervised harm arises from the Trainer's negligence;
6. you are not entitled to bring any guests to a training session without the Trainer's prior consent, and if you do so, the Trainer may, at their sole discretion, suspend or cancel your training session. You will be responsible for any fees due to the Trainer;
7. the Trainer has the right to cancel your training session if you do not behave in an orderly manner, are under the influence of drugs or alcohol, are abusive to the Trainer or other clients, use equipment improperly, dangerously, or in a way that may lead to personal injury (whether to yourself or others), or you cause property damage of any kind;
8. you have been advised to consult with a physician before beginning any exercise program with the Trainer, and you confirm that you have either done so or have chosen to proceed without medical consultation at your own risk;
9. you are at least 18 years of age. The Trainer does not provide training services to clients under 18 years of age.
CANCELLATION AND LATE ARRIVAL
Clients may cancel a scheduled training session up to 24 hours before the appointment at no charge. Any cancellations made less than 24 hours before the scheduled appointment will result in the client being billed for the full session if the Trainer cannot reschedule the session for that same day or week.
If a client arrives less than 15 minutes late to a scheduled session, the Trainer may extend the session to make up the lost time, provided there is no other business booked immediately afterward.
No penalties will be assessed due to Trainer's lateness or cancellation, and any amounts already charged will be refunded.
PAYMENT POLICIES
Payment is due at the time of service, and can be made via Zelle (preferred), Venmo, or physical credit/debit card. Please note the following payment processing fees:
Zelle: 0% (free)
Venmo: 1.9%
Credit/Debit: 3%
An electronic invoice and receipt will be provided upon request.
Late payments will incur 1.5% interest per month after 30 calendar days. Clients with an outstanding balance will not be able to book new sessions.
Any special accommodations or payment issues may be considered but must be discussed with the Trainer prior to beginning the training session.
FILMING/PHOTOGRAPHY/DATA COLLECTION
I agree that:
1. as a routine part of every fitness session, Stepp Up Fitness may need to film or photograph me in order to evaluate my form and progress. I give my full permission for this, understanding that these images will be stored privately, accessible only to Stepp Up Fitness. They will not be used in any public-facing manner (e.g. website, YouTube, Instagram, TikTok, etc) without my consent. I understand that I may request that these records are deleted at any time, and I may notify Stepp Up Fitness at any time if I wish to opt-out of being filmed.
2. I will not film or photograph any portion of my session without explicit authorization from Stepp Up Fitness. If permission is given, any film or images taken may not include any 3rd parties in the frame other than my Trainer.
3. in order to provide the most complete picture of my health, various workout metrics such as heart rate, sets, reps, and other non-identifying biometric and demographic data may be collected and used by the Trainer in both personalized and anonymized reports and research.
ENFORCEABILITY
If any provision of this waiver is found to be void, unenforceable, or contrary to public policy in any jurisdiction, it shall be severed for that jurisdiction only. You acknowledge that the remainder of this waiver shall remain in full force and effect, and the validity or enforceability of that provision in any other jurisdiction is not affected.
