  • Advertising Agreement

  • This Advertising Agreement (“Agreement”) is a legally binding contract.
    By clicking “I Agree,” “Accept,” or submitting payment, the Advertiser agrees to the terms below.

    This Advertising Agreement (“Agreement”) is entered into between Smokies.Live, owned by Kyle Grainger (“Publisher”), and * (“Advertiser”).

  • 1. Advertisement Placement

    Publisher agrees to display Advertiser’s advertisement on the Smokies.Live website.

  • 2. Term

  • The advertisement will run for a period of * days, beginning on   Pick a Date*   and ending on   Pick a Date*   , unless terminated earlier under this Agreement.

  • 3. Payment

  • Advertiser agrees to pay Publisher the amount of $27 per day or $11 per day for their selected advertisement placement for the advertising term stated above.

    • Payment is due in full prior to the advertisement going live, unless otherwise agreed in writing.
    • Fees are non-refundable, including in cases of early removal, unless Publisher agrees otherwise in writing.

  • 4. Advertiser Content & Responsibility

  • Advertiser represents and warrants that:

    • They own or have full legal rights to all advertisement content, including images, logos, and text.
    • The advertisement does not infringe upon copyrights, trademarks, privacy rights, or any other third-party rights.
    • The advertisement complies with all applicable laws and regulations.

    Advertiser agrees to indemnify and hold harmless Smokies.Live and its owner from any claims, damages, or legal actions arising from the advertisement.

  • 5. Publisher Rights

  • Publisher reserves the right to:

    • Reject, remove, or require changes to any advertisement at its sole discretion.
    • Remove advertisements that are misleading, illegal, offensive, or in violation of this Agreement, without refund.

  • 6. No Performance Guarantee

  • Publisher makes no guarantees regarding:

    • Website traffic
    • Advertisement views or clicks
    • Sales or business results

  • 7. Limitation of Liability

  • Publisher shall not be liable for any indirect, incidental, or consequential damages related to the advertisement or its display.

  • 8. Governing Law & Venue

  • This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee. Any legal action or proceeding arising from this Agreement shall be brought exclusively in the state or federal courts located within Tennessee.

  • 9. Electronic Acceptance

  • By clicking “I Agree," signing below, and submitting payment, Advertiser acknowledges that:

    • They have read and understood this Agreement
    • They are authorized to enter into this Agreement on behalf of the business
    • This electronic acceptance is legally binding and equivalent to a handwritten signature
