    Terms of Service Agreement

    This Terms of Service Agreement ("Agreement") is entered into by and between Motor City Sitters ("MCS") and the Client ("Family") availing the babysitting placement services provided by MCS. By accessing or using the MCS website or services, the User agrees to be bound by these terms and conditions. 

    1. Services Provided

    1a. MCS offers babysitting placement services to connect families with qualified babysitters. MCS acts as an intermediary platform facilitating the connection between families seeking babysitting services ("Families") and individuals providing babysitting services ("Sitters").

    1b. MCS does not employ Sitters directly but provides a platform for Families to connect with Sitters. MCS does not provide babysitting services directly and does not have control over the quality, timing, legality, or any other aspect of the services provided by the Sitters.

    2. User Responsibilities

    2a. Family must provide accurate and up-to-date information when registering for MCS services.

    2b. MCS is responsible for conducting interviews, background checks, and determining the suitability of Sitters for families specific needs.

    2c. Family is responsible for communicating with MCS to adequately specify their sitter needs including but not limited to: qualifications wanted, dates and times needed.  

    3. Fees and Payments

    3a. Families agree to pay the fees specified by MCS for the use of its services. Fees may vary based on the type and duration of services requested.

    3b. Placement fees must be submitted through the MCS platform. MCS reserves the right to suspend or terminate services for Users with outstanding payments.

    3c. Placement fee must be paid in full when booking placement with MCS.  Placement fees are nonrefundable. 

    3d. Family is responsible for paying the sitter referred to them directly at the specified hourly rate set by MCS. Payment is to be made at the end of each care period. 

    4. Placement of Caregiver

    4a. Motor City Sitters will use its best efforts to match a suitable Caregiver based on the family's needs and preferences. 


    4b. Fees and Payments: The family agrees to pay Motor City Sitters the agreed placement fee for the services rendered. Payment terms and the amount shall be as agreed upon separately between Motor City Sitters and the family.


    4c. Responsibilities of Motor City Sitters: Motor City Sitters will conduct background checks on Caregivers to the best of their ability. Motor City Sitters will provide ongoing support and assistance as reasonably necessary during the placement period.

    5. Limitation of Liability

    5a. MCS is not liable for any damages, losses, or disputes arising from the use of its services, including but not limited to disputes between Families and Sitters, or any actions or omissions of Sitters.

    5b. MCS does not guarantee the availability of Sitters or the accuracy of information provided by Sitters or Families.

    5c. If the sitter cancels MCS will find a replacement for the family with a waived placement fee. 

    5d. If the family cancels within 24 hours of the care start time or within 12 hours if the booking was made less than 24 hours in advance the family will be billed for two hours of care per booking day and a cancellation fee as follows:

    • $50 for bookings of 1–4 days 
    • $100 for bookings of 5 or more days.
    • Failure to pay the invoice within 48 hours the family's card on file will be charged automatically or if no card is on file non payment may result in the family being referred to small claims court by Motor City Sitters.

    5e. If the family requests to change the date of a confirmed booking, it will be treated as a cancellation. The original booking will be subject to the same cancellation fees outlined in section 5d, and a new placement fee will be required to secure care for the new date.

    5f. Initial palcement fees paid to MCS are nonrefundable. 

    6. Termination

    6a. MCS reserves the right to suspend or terminate services to any User for violation of these terms and conditions or for any other reason at its discretion.

    6b. Users may terminate their account with MCS at any time by contacting customer support.

    6c. Family agrees that during the term of their relationship with Motor City Sitters (MCS), they shall not directly or indirectly contact any babysitter referred by the Agency for care without the express consent of the Agency. Any attempt to circumvent the Agency in this manner shall constitute a material breach of this Agreement. In the event of such a breach, the Family agrees to pay a fee three times the booking fee per day of care needed by the Agency. Additionally, the Agency reserves the right to immediately terminate the Family's placement and remove them from the Agency's client list

    This Non-Compete provision shall survive the termination of this Agreement.

    7. Miscellaneous

    7a. This Agreement constitutes the entire agreement between MCS and the User and supersedes any prior agreements or understandings.

    7b. This Agreement shall be governed by and construed in accordance with the laws of the state of Michigan. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of the state of Michigan.

    By accessing or using MCS services, the User acknowledges that they have read, understood, and agree to be bound by these terms and conditions.
