    Consigner & Consignee Agreement

     

    These Terms & Conditions (“Terms”) are made between:

     

    Consigner: __________________________________ (“Consigner”)

    Consignee: Valeria Smart - Vale’s Destash (“Consignee”)

     

    By signing below, both parties agree to the following Terms & Conditions for consignment sales.

     

    1. Purpose

    These Terms outline how the Consigner’s jewelry will be sold by the Consignee (Vale) during TikTok live sales and related selling events.

     

     2. Items Accepted

    • Items must be authentic Bomb Party products unless Vale approves exceptions in writing beforehand
    • Items should arrive in original packaging when possible.
    • Singles (bracelets, Luxe Layers, necklaces) are allowed.
    • Items must be new or like-new condition.  
    • Inventory List Requirement (Optional)

    The Consigner may choose to provide a detailed inventory list (style, size, quantity, etc.).
    If the Consigner does NOT provide an inventory list:

    Vale is NOT responsible for:

    *Missing items
    *Incorrect quantities
    *Style or size discrepancies
    *Misidentified items
    *Value disputes
    *Any item-tracking or verification

    Items will be sold exactly as received without question.

     

    3. Responsibilities of Vale (Consignee)

    • Vale will sell the items during TikTok live sales (“lives”).
    • Vale will host a minimum of three (3) live sales featuring the items within the first two (2) weeks of receiving them. Additional showings may be offered depending on Vale’s live schedule, the number of consignments she is managing, and the inventory that needs to be showcased. While Vale will make every reasonable effort to promote the items, she cannot guarantee that all items will sell.
    • Vale will determine pricing unless the Consigner provides written pricing.
    • Vale will provide all shipping materials for customer orders.
    • All unsold items will be returned to the Consigner at the end of the consignment period.

     

    4. Earnings & Payment

    • The Consigner earns 65% of total sales revenue.
    • Vale retains 35% for work, time, hosting, packaging, and supplies.
    • Live sales run from Saturday through Thursday each week.
    • Friday is designated as the shipping and order-finalization day (no live sales).
    • Payments will be issued on the Tuesday following the shipping day for all items sold during the prior Saturday–Thursday live week.
    • Payments will be sent via the Consigner’s preferred payment method (PayPal, Cash App, or Venmo).
    • Once payment is issued to the Consigner, the sale is considered final.
    • The Consigner may not request refunds, reversals, or chargebacks once payment has been sent.
    • Friday will be my shipping day (no lives). Once all orders from that week are shipped, payouts for items sold Saturday–Thursday will be sent the following Tuesday.

    The Consigner may not request:

    Refunds/Chargebacks

     

    5. Shipping & Costs

      Return Shipping Requirement

    • The Consigner must provide a return label within 5 business days once notified of unsold items.
    • If no label is provided within 5 days, Vale is not required to store items indefinitely.

     

    6. Ownership & Liability

    All items remain property of the Consigner until sold.

    Vale will store and handle items responsibly.

    Vale is NOT liable for:

    • Postal delays
    • Lost packages
    • TikTok/platform malfunctions
    • Damage during transit
    • Any unforeseen issues outside of Vale’s control.

     

    7. Social Media Permission

    •  The Consigner agrees their items may be shown, photographed, or displayed on TikTok and other social media platforms for sales and promotional purposes.

     

    8. Termination

    Either party may terminate these Terms with written notice.

    Upon termination:

    All unsold items will be returned.
    The Consigner will receive payment for any items sold before termination.

     

    9. Full Agreement

    These Terms & Conditions represent the entire understanding between the Consigner and the Consignee (Vale).

    Any changes must be made in writing and agreed to by both parties.
