Deed Restricted HOA/DUCIOA vs. Civic Association

A deed restricted HOA is a community where homeowners are subject to both rules recorded with the property's deed with the local jurisdiction and rules created by the local governing body OR builder - both can legally limit what homeowners can do to their property.
A deed restriction might say you can't build a shed in your yard or own a certain breed of dog and/or can govern the height/type of fence to be installed.
DUCIOA
In order to sell, the community must provide financial disclosures for potential buyers - usually at the seller's expense.
Example of DUCIOA eligible communities
- HOA community with annual fee more than $700/year
- Condo Association/Co-Op
A civic association is a voluntary community group that focuses on broader community issues such as safety, beautification projects, and public services and advocating for neighborhood interests to local government and other organizations, lobbying for improvements and changes that benefit the area.
HOAs with lower annual fees tend to handle beautification of common areas and snow removal.
