General Waiver and Release of Liability Form
PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS. BY SIGNING THIS WAIVER AND RELEASE OF LIABILITY ("Agreement"), YOU ARE AGREEING TO RELEASE AND WAIVE CERTAIN LEGAL RIGHTS.
1. Parties
This Waiver and Release of Liability is entered into between F.A.B. (Flourishing After Ball) (hereinafter referred to as "F.A.B.") and the undersigned participant or legal guardian (hereinafter referred to as "Participant" or "Guardian"), collectively referred to as the "Parties."
2. Activity Description
Participant acknowledges that F.A.B. provides programs, activities, and events that may include physical sports, sports-specific training, recreational games, educational workshops, mentorship programs, and other related events (hereinafter referred to as the "Activities"). These Activities may involve participation in various sports, physical conditioning, team-building exercises, and educational seminars designed to promote personal and professional growth.
3. Acknowledgment of Risks
Participant acknowledges and understands that engaging in the Activities involves inherent risks, including but not limited to:
Physical Risks: Risks associated with physical activity such as sprains, strains, fractures, or injuries.
Sports-Specific Risks: Risks arising from contact with other participants, equipment, or playing surfaces during sports activities.
Environmental Risks: Uneven surfaces, equipment malfunctions, or unpredictable circumstances.
Social Risks: Interactions with other participants that could result in misunderstandings, accidents, or disputes.
Negligence by Others: Actions or omissions by other participants, agents, or staff that may lead to harm.
Participant acknowledges that while safety measures will be in place, risks cannot be completely eliminated, and accidents or injuries may occur.
4. Waiver and Release of Liability
In consideration of being allowed to participate in the Activities, Participant, on behalf of themselves or any minor for whom they are the legal guardian, agrees to the following:
Assumption of Risk: Participant assumes full responsibility for any risks, known or unknown, associated with the Activities.
Release from Liability: Participant releases, waives, and holds harmless F.A.B., its directors, officers, employees, agents, volunteers, and contractors from any claims, demands, or actions arising out of or in connection with the Activities or their presence at any F.A.B. facility or event.
Medical Authorization: Participant authorizes F.A.B. to seek emergency medical care on their behalf in the event of injury or illness and assumes full responsibility for associated costs.
Fitness Representation: Participant represents that they are physically and mentally capable of participating in the Activities and have not been advised otherwise by a qualified professional.
5. Media Release
Participant grants F.A.B. the right to use their name, image, likeness, or voice in photographs, videos, or other media taken during the Activities for promotional, educational, or marketing purposes without compensation.
6. Compliance with Rules
Participant agrees to adhere to all rules, regulations, and instructions provided by F.A.B. staff or representatives. Failure to comply may result in removal from the Activities without a refund.
7. Personal Information
Participant consents to F.A.B. collecting and using their personal information for communication and administrative purposes. F.A.B. will not sell or share personal information with third parties without consent.
8. Governing Law and Jurisdiction
This Agreement shall be governed by and construed under the laws of Ontario, Canada, and any disputes arising from this Agreement will be resolved exclusively in the courts located in Ontario.
9. Severability Clause
If any portion of this Agreement is found to be invalid or unenforceable, the remaining sections shall remain in full force and effect.
By signing below, Participant acknowledges that they have read this entire Waiver and Release of Liability, fully understand its terms, and voluntarily agree to its content.
