TERMS AND CONDITIONS
1. Accuracy of Information
By submitting the pre-order or regular order form provided by Legisperit , the buyer confirms that all information provided is true, accurate, and complete. Any misrepresentation or provision of false information may result in legal action and prosecution under applicable laws of the Philippines.
2. Intellectual Property
All books and other publications purchased from Legisperit are protected by the intellectual property laws of the Philippines. Any unauthorized reproduction, sale, distribution, or similar acts involving Legisperit's publications will be prosecuted to the fullest extent of the law. This includes, but is not limited to:
- Criminal action for violation of intellectual property and other penal laws of the Philippines.
- Actions for damages to recover losses incurred by Legisperit due to unauthorized activities.
- Legal actions for disbarment or complaints filed with the Office of the Bar Confidant against individuals involved in unauthorized activities.
3. Legal Actions and Remedies
Legisperit reserves the right to pursue all legal remedies available, including but not limited to, filing civil and criminal cases against individuals or entities involved in any form of misrepresentation or unauthorized use of Legisperit's intellectual property.
4. Refund and Replacement Policy
All sales are considered final, subject strictly to the rights granted under applicable law.
Refunds shall not be granted as a matter of course and shall be allowed only in clearly justified cases involving defective, damaged, non-conforming, or undelivered products attributable to Legisperit.
As a general rule, replacement shall be the primary remedy, and refund shall be granted only when replacement is not feasible, practical, or reasonable under the circumstances, or when otherwise required by applicable law.
Requests for Replacement or Refund
All requests must be supported by:
- Valid proof of purchase (e.g., official receipt, invoice, or order confirmation); and
- Reasonable evidence of the defect or issue, such as photographs, videos, or other documentation, when practicable.
Legisperit reserves the right to require return, inspection, or verification of the product prior to approval of any claim.
Requests may be granted only under the following circumstances:
- The product is defective or damaged, not attributable to the customer;
- The product delivered is incorrect or materially different from the order;
- The product was not delivered or was lost in transit, where shipping was arranged by Legisperit;
- There is non-fulfillment of the order attributable to Legisperit.
The customer must report any issue within seven (7) days from receipt or discovery, whichever is earlier. Failure to report within this period may be a ground for denial of the claim, unless the nature of the defect reasonably justifies a longer period under applicable law.
Conditions for Return
Where return of the product is required:
- The product must be returned in substantially the same condition as received, except for defects being claimed;
- Complete packaging, accessories, and inclusions must be returned, when applicable;
- Legisperit reserves the right to reject claims where returned items are incomplete, tampered with, or show signs of misuse.
Return shipping costs shall be:
- Shouldered by Legisperit, if the claim is found valid and attributable to Legisperit;
- Shouldered by the customer, if the claim is denied or found to be not attributable to Legisperit.
Exclusions and Limitations
- Legisperit shall not be liable for refund or replacement in the following cases:
- Damage due to misuse, abuse, or mishandling;
- Normal wear and tear;
- Minor or insignificant defects that do not materially affect the product’s functionality or intended use, as reasonably determined in accordance with applicable law and industry standards;
- Change of mind, erroneous purchase, or failure to review product specifications;
- Loss, delay, or damage during shipment where the courier was arranged solely by the customer;
- Fortuitous events or force majeure.
Non-Liability for Fraudulent or Unauthorized Transactions
Legisperit shall not be liable for losses arising from the unauthorized or fraudulent use of payment instruments (including, but not limited to, credit or debit cards, e-wallets, or similar payment platforms), provided that:
- Payment was received in good faith through authorized channels;
- The transaction was processed or authorized by the relevant financial or payment institution;
- Legisperit had no knowledge or reasonable basis to suspect fraud at the time of the transaction; and
- Legisperit has fulfilled its delivery obligations in accordance with the order details.
Legisperit reserves the right to suspend, hold, or refuse fulfillment of suspicious transactions pending verification.
This provision shall be without prejudice to the rights of the cardholder/accounholder to initiate a dispute or chargeback with the issuing bank or payment provider, and subject to applicable laws, rules, and regulations, including those governing payment processors and financial institutions.
Shipping and Risk Allocation
Where shipment is arranged by Legisperit, risk of loss shall remain with Legisperit until actual delivery to the customer or authorized recipient.
Where shipment is arranged by the customer, risk of loss shall pass upon turnover of the product to the chosen courier, provided that the product was in good condition at the time of dispatch.
Refund Process
Approved refunds shall be processed within two (2) to five (5) business days from final approval.
Refunds shall be issued through:
- The original mode of payment, where feasible; or
- Bank or e-wallet transfer under the customer’s name; or
- Other reasonable means as determined by Legisperit.
Where the refund is due to Legisperit’s fault, the full purchase price paid shall be refunded.
Where a refund is granted for reasons not attributable to Legisperit, if exceptionally allowed, Legisperit reserves the right to deduct reasonable processing fees, payment gateway charges, and similar costs, to the extent permitted by law.
Verification and Determination
All claims shall be subject to strict verification and evaluation by Legisperit.
Legisperit’s determination shall be based on:
- The evidence submitted;
- Inspection findings, if applicable; and
- Applicable laws and industry standards.
Such determination shall be made in good faith and shall not prejudice the customer’s right to elevate the matter to appropriate government agencies or dispute resolution bodies.
Dispute Resolution
In case of dispute, the customer may seek assistance from the Department of Trade and Industry (DTI) or avail of dispute resolution mechanisms under applicable laws or relevant e-commerce platforms.
Construction and Separability Clause
This Policy shall be construed in accordance with applicable laws. Any provision inconsistent with mandatory consumer protection laws shall be deemed modified to conform thereto, without affecting the validity of the remaining provisions.
5. Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the Philippines. Any disputes arising from or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of the Philippines in Las Piñas City.
6. Changes to Terms and Conditions
Legisperit reserves the right to modify these terms and conditions at any time without prior notice. Any changes will be posted on the Legisperit website and will be effective immediately upon posting.
7. Acceptance of Terms
By using the Legisperit website and submitting the pre-order or regular order form, the buyer acknowledges that they have read, understood, and agreed to these terms and conditions.
