Content Ownership & Usage Agreement
By submitting an image/photograph or content to Smokies.Live, you agree to the following:
Ownership & Rights
You confirm that you are the original creator and rightful owner of the submitted image/content, or that you have full legal permission from the owner to submit it.
You confirm that the image/content does not violate any copyright, trademark, privacy, or publicity rights of any third party.
You confirm that any identifiable individuals in the image have given permission for their likeness to be used.
Permission to Use
You grant Smokies.Live, its owner, and affiliates a non-exclusive, royalty-free, worldwide license to use, display, reproduce, share, publish, and distribute the submitted image on:
- Social media platforms
- The Smokies.Live website
- Promotional, marketing, or informational materials related to Smokies.Live
Attribution
When reasonably possible, credit may be given to you as the source of the image or content. However, attribution is not guaranteed.
No Compensation
You understand and agree that no compensation or payment will be provided for the use of the submitted image or content.
Indemnification
You agree to hold harmless and indemnify Smokies.Live and its owner from any claims, damages, or legal disputes arising from the use of the submitted image/content.
Right to Remove
Smokies.Live reserves the right to remove or stop using any submitted image/content at its discretion.
Governing Law & Venue
This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located within the State of Tennessee.
Acceptance
By clicking “I Agree” or submitting an image/content, you acknowledge that you have read, understood, and agreed to this Content Ownership & Usage Agreement.
