CARAVAN TRIP PLAN – SKI TRIP PARTICIPANT WAIVER & RELEASE OF LIABILITY

PLEASE READ CAREFULLY. THIS IS A LEGAL DOCUMENT. BY SIGNING, YOU WAIVE CERTAIN LEGAL RIGHTS.
I, the undersigned, voluntarily choose to participate in a ski trip organized by Caravan Trip Plan LLC (“Caravan Trip Plan”). I understand that skiing, snowboarding, winter travel, chairlifts, equipment use, and alpine environments involve significant, inherent risks, including but not limited to slips, falls, collisions, terrain changes, variable snow/ice conditions, severe weather, transportation, equipment malfunctions, and other unforeseen hazards.
1. Assumption of Risk
I understand and acknowledge the inherent dangers of skiing, snowboarding, winter activities, and traveling to and from the ski resort. These risks include injury, disability, illness, property damage, and death. I voluntarily assume full responsibility for all risks associated with my participation, whether foreseeable or not.
2. Release of Liability
To the fullest extent permitted by law, I release and discharge Caravan Trip Plan LLC, its owners, members, managers, employees, volunteers, agents, drivers, trip leaders, partners, and affiliates from any and all claims, demands, causes of action, liabilities, or expenses arising from my participation in this ski trip, including those caused by the negligence or wilful misconduct of third parties, other participants or other guests or skiers at the ski resort. I understand that Caravan Trip Plan is not responsible for conditions or actions at the ski resort, on the mountain, in rental shops, on chairlifts, or during skiing/snowboarding activities.
3. Equipment, Rentals & Ski Resort Operations
I understand that:
- Caravan Trip Plan does not provide ski or snowboard equipment.
- Any rentals I obtain are governed by the rental shop’s own policies and liability forms.
- Caravan Trip Plan is not responsible for equipment malfunctions, improper fit, or injuries related to equipment use.
- Ski resorts operate independently from Caravan Trip Plan, and Caravan is not responsible for lift operations, closures, delays, grooming, terrain parks, or resort staff decisions.
4. Transportation & Travel
I acknowledge that travel by charter bus or other vehicle involves risks, including accidents, weather delays, road conditions, and interactions with third-party transportation providers. I release Caravan Trip Plan from all liability related to transportation incidents or delays.
5. Weather, Conditions, Changes & Cancellations
I understand that skiing is weather-dependent and conditions can change rapidly. I acknowledge that Caravan Trip Plan may alter, delay, reroute, or cancel all or part of the trip due to weather, road conditions, resort capacity, safety concerns, or operational issues.
I agree that Caravan Trip Plan is not responsible for any additional personal costs, losses, or damages incurred due to such changes.
6. Personal Responsibility & Conduct
I agree to ski and behave safely and responsibly, follow all resort and Caravan Trip Plan rules, guidelines and instructions, remain in designated areas, and ski/ride within my ability level. I understand I am fully responsible for the consequences of risky behavior or failure to follow all rules, guidelines or instructions.
7. Medical Treatment & Expenses
I confirm that I am physically able to participate in winter sports and have not been advised otherwise by a healthcare professional. I understand Caravan Trip Plan does not provide medical insurance. I authorize emergency medical care if necessary and accept full financial responsibility for any related expenses.
8. Photography & Media Consent
I grant Caravan Trip Plan permission to use photos and videos taken of me during the trip for promotional purposes, including website and social media posts, without compensation.
9. Alcohol Consumption (if applicable)
If alcohol is available or consumed, I certify that I am at least 21 years old. I accept full responsibility for my actions and acknowledge Caravan Trip Plan is not liable for any injury or damage related to alcohol use.
10. Miscellaneous
This Release is the entire agreement between Caravan Trip Plan and me regarding liability and supersedes all prior communications. If any part of this Release is found unenforceable, the remaining sections shall remain in effect. This Release is governed by the laws of the State of New York. Any disputes may be brought only in federal or state courts located in New York County, NY.
By signing below, I acknowledge that I have read and fully understand this Release and voluntarily agree to its terms.
