    1. All work will meet the requirements of the appropriate Microgeneration Installation Standard and to any publication referred to within that standard, and where appropriate will be carried out in full compliance with the HIES Consumer Code and where relevant, for PAS 2030 work, MCS 023. If applicable, all scaffolding works shall be carried out in accordance with all applicable legislation, industry standards and best practice guidance, including but not limited to the Work at Height Regulations 2005, TG20 and SG4 guidance, and any site-specific requirements notified by Emerald Green Energy Ltd.

    2. The subcontractor will ensure that where required, all notifiable work will be informed to Building Control in an appropriate manner for the area of work and the geographical location of such works. If applicable, the subcontractor shall ensure that any licences, permits, pavement permits, highway permissions or local authority consents required for the erection or placement of scaffolding are obtained where the subcontractor is responsible for arranging such items.

    3. All persons involved will have the necessary qualifications and competences to carry out the tasks they are required to perform. All information and proof of qualifications will be supplied to us upon our request

    4. The subcontractor is responsible for ensuring that a thorough and competent risk assessment is carried out for each installation by a person (s) qualified to do so, a copy of which should be supplied to us. This includes risk assessments and method statements.

    5. The subcontractor must agree that whilst carrying out work for us they will be present at all Internal Review Meetings we hold where reasonably required.

    6. If applicable, the subcontractor is responsible for maintaining any measuring equipment used in a known state of calibration, information on such calibration will be forwarded to us.

     

    7. The subcontractor agrees that representatives of Emerald Green Energy Ltd may be present at the commissioning of installations

     

    8. Work will be carried out to the timescale agreed when an instruction is placed. 

    9. The subcontractor will comply with all applicable Health & Safety legislation and ensure that each work activity is properly governed by qualified personnel

    10. The subcontractor will, while carrying out work for us, be expected to do the following:

     

    ·         Provide us and the client with all necessary paperwork as detailed in our policies and procedures

     

    ·         Accommodate any changes to the proposed installation where possible as per either our or the client's request

     

    ·         Inform us immediately of any complaints received from the client along with details of what steps have been taken to rectify the said complaint.

    11. The subcontractor agrees that a job will not be deemed complete until Emerald Green Energy Ltd has received, reviewed and accepted all required completion evidence, including photographs, documents, certificates and any other information requested by Emerald Green Energy Ltd or its Live Check Team, in line with the shared checklist. Emerald Green Energy Ltd may withhold payment where any required evidence is missing, incomplete, unclear, inaccurate or non-compliant until it has been supplied and accepted.


    12. Where scaffolding is arranged, supplied or controlled by the subcontractor, the subcontractor shall ensure that all scaffolding is removed from site within seven calendar days of completion of the relevant works, unless otherwise agreed in writing by Emerald Green Energy Ltd. This clause shall not apply where scaffolding is arranged and controlled by an external third party not appointed, managed or instructed by the subcontractor.


    13. The subcontractor and its operatives must act professionally, respectfully and appropriately at all times when dealing with customers, Emerald Green Energy Ltd staff and third parties. Operatives must attend as agreed, communicate promptly, respect customer property, follow reasonable instructions and avoid any conduct that may damage Emerald Green Energy Ltd’s reputation or commercial interests.

    Where Emerald Green Energy Ltd suffers loss, complaint, cancellation, remedial cost or reputational damage due to the subcontractor’s conduct, non-attendance, poor communication or workmanship, Emerald Green Energy Ltd may recover reasonable losses from the subcontractor, including by deduction from sums due.


    14. The subcontractor must notify Emerald Green Energy Ltd as soon as possible if they are unable to attend any scheduled installation, survey, remedial visit or appointment. If the subcontractor fails to attend without prior notice and a valid reason, Emerald Green Energy Ltd may apply a no-show charge, including an equivalent charge to any attendance fee payable in similar circumstances, currently £450. Repeated non-attendance, late attendance, poor communication or cancellations may result in suspension of work, recovery of losses or termination of the subcontractor relationship. Emerald Green Energy Ltd will provide reasonable details of any deduction applied.


    15. Emerald Green Energy Ltd may deduct from sums due to the subcontractor any reasonable costs or losses arising from breach of this agreement, including repeated no-shows, failed appointments, missing evidence, remedial works, scaffolding delays, property damage, complaints or unprofessional conduct.

    16. The subcontractor shall provide scaffold handover certificates and inspection records where required by law or industry guidance.

    17. The subcontractor shall maintain adequate public liability insurance, employer’s liability insurance and any other insurance reasonably required for the works, and shall provide evidence along with this form.

    18. The subcontractor shall take reasonable care to avoid damage to property and shall notify Emerald Green Energy Ltd immediately of any damage caused during the works.

    19. The subcontractor may suspend scaffolding works where weather conditions or site conditions make the works unsafe. This must be notified to Emerald Green Energy as soon as reasonably possible.
