Dear Client,
Thank you for choosing Taxes With Kayla for your income tax preparation needs. This letter outlines our mutual understanding, responsibilities, and the terms under which we will provide professional services. Please read carefully, as this document serves as a legally binding agreement between you (“the client”) and Taxes With Kayla (“the preparer”).
Scope of Engagement
Taxes With Kayla will prepare your 2025 federal and applicable state income tax returns based on the information you provide. Our services are limited to tax preparation and electronic filing. This agreement does not include bookkeeping, payroll, legal representation, financial planning, or any other services unless specifically agreed to in writing. We will not audit, review, or verify the data you submit, though we may request clarification or supporting documentation to ensure compliance. This engagement does not include detecting fraud or irregularities of any kind.
Client Responsibilities
You are responsible for providing complete, accurate, and timely information necessary to prepare your return. You must maintain all original records—such as W-2s, 1099s, receipts, mileage logs, and other documentation—to support the items claimed. We rely on the accuracy of your submissions. You acknowledge that any errors, penalties, or additional taxes resulting from incomplete or inaccurate information are solely your responsibility. If you provide information verbally, your signature on this engagement letter confirms its accuracy. You agree to review your completed return carefully before signing and authorizing e-filing.
Tax Credits and Filing Status
If you are claiming credits such as the Earned Income Credit, Child Tax Credit, Additional Child Tax Credit, Education Credit, or filing as Head of Household, you confirm that all information—including dependent eligibility and household status—is true and meets all IRS and state requirements. You are responsible for retaining documentation to substantiate each credit or filing status in the event of audit or verification.
Record Retention
Taxes With Kayla retains electronic copies of engagement records for up to three years after your return is filed. After that time, records may be securely destroyed. You should maintain your own copies of tax documents for at least seven years. Original source documents are returned to you after services are completed, as we do not keep client originals.
Legal and Financial Responsibilities
You understand that all filings are based solely on the information you provide. Submitting false or misleading data is unlawful and may result in penalties or prosecution.
Taxes With Kayla is not responsible for any taxes owed, penalties, or interest resulting from incomplete or inaccurate information, delayed documentation, or government processing errors. Our liability is strictly limited to the amount of fees paid for the specific services provided. If an error occurs due to our mistake, we will correct it at no additional charge and reimburse penalties and interest directly caused by that error—excluding the underlying tax owed.
Audit and Examination
Tax returns may be selected for review or audit by the IRS or state agencies. Audit representation or correspondence assistance is not included in the standard tax preparation fee and will require a separate written agreement and additional charge. You are responsible for providing all documentation requested by tax authorities.
Fees and Payment
Tax preparation fees are determined by the complexity of your return and the time required for completion. Payment is due when services are rendered unless you have made arrangements for bank product payment. Fees are not contingent on receiving a refund or the amount of a refund. Returns may be withheld from filing until balances are paid in full.If you choose to have your tax preparation fees deducted from your refund and your refund is delayed, reduced, or intercepted for any reason, you are still fully responsible for paying the tax preparation fees. Choosing a bank product does not remove your obligation to pay for services rendered. If you choose to have preparation fees deducted from your refund, this requires a bank product. This convenience comes with additional processing fees charged by the bank.Typical costs include (example — adjust based on your bank): Bank processing fee, Technology fee, and Refund transfer fee. These fees are not charged by Taxes With Kayla and will reduce your refund amount. This option is convenient if you prefer no upfront payment, but does cost more overall. Don't worry - we are still more affordable than our competitors! By signing your tax return, you acknowledge and agree that the preparation fees are due regardless of whether you receive your refund. If your refund is intercepted or not issued, you must contact Taxes With Kayla immediately to make payment or to arrange a payment plan.If no payment or payment arrangement is made within 90 days from the date your refund was scheduled to arrive, your account may be sent to collections. We do not want to take this step, so please maintain open communication with us so we can work with you and avoid any unnecessary complications.
Confidentiality and Data Protection
Taxes With Kayla complies with all applicable privacy laws, including IRS Code §7216 and the Gramm-Leach-Bliley Act. We will not disclose your personal information to third parties without your written consent, except as required by law.
We take all reasonable precautions to safeguard your information through secure systems and storage. However, you acknowledge that electronic communication—such as email or text—may not be fully secure, and we are not liable for unauthorized access or interception beyond our control.
Electronic Communication and Consent
By signing this agreement, you consent to receive electronic communication from us, including invoices, updates, appointment reminders, and signature requests. You may opt out at any time by replying “STOP” to text messages or unsubscribing from emails.
IRS Discussion Authorization
You authorize Taxes With Kayla to communicate directly with the IRS regarding your 2025 tax return for up to one year following the original filing deadline to clarify or resolve minor issues.
Termination of Services
Either party may terminate this agreement in writing at any time. You agree to pay for work performed and expenses incurred through the date of termination. If documentation or communication is not provided in a reasonable timeframe, Taxes With Kayla reserves the right to terminate services without liability. Please note that if you choose not to proceed with our tax preparation services after submitting your information, a $50 document processing and storage fee will apply. This fee covers the secure review, handling, and storage of your records in compliance with federal and industry data protection standards.
Limitation of Liability and Indemnification
To the fullest extent allowed by law, Taxes With Kayla, its owner, employees, and agents shall not be liable for any damages, losses, or expenses arising from this engagement except those resulting from willful misconduct or gross negligence. You agree to indemnify and hold harmless Taxes With Kayla from any claims, liabilities, or costs resulting from your failure to provide accurate information or comply with tax laws.
Dispute Resolution
Any dispute under this agreement will first be addressed through good-faith discussion. If unresolved, both parties agree to binding arbitration in Van Zandt County, Texas, under Texas law. You waive any right to participate in a class or collective action.
Entire Agreement
This engagement letter represents the full and final understanding between you and Taxes With Kayla for the 2025 tax year. No verbal agreements or prior discussions will modify these terms unless confirmed in writing and signed by both parties.By signing below, you acknowledge that you have read, understand, and agree to all terms of this engagement letter and authorize Taxes With Kayla to prepare and file your 2025 income tax returns in accordance with this agreement.
