  • LICENSE TERMS AND CONDITIONS

  • The term "Marina" used herein includes the City of Silver Bay, Minnesota, and any person
    authorized to represent the operators of the Silver Bay Marina. The term "Boat Owner" used
    herein indicates the Boat Owner listed on this License Application (or the owner's authorized
    representative) of any boat moored in the Marina.
  • The following terms and conditions are agreed to between the Marina and Boat
    Owner. By signing below, Boat Owner acknowledges they have read and accept these terms
    and conditions as a condition of receiving a license for a seasonal Marina slip.
  • 1. Marina Season is May 15 to October 15 (weather permitting).
  • 2. Boat Owner must complete this application and make payment in full of the seasonal slip fee along with proof of insurance each season PRIOR to docking. Boat Owner will pay all reasonable costs to collect for insufficient funds or non-payment of slip fees, including reasonable attorney's fees. A $25 per month late charge applies to all past due balances.
  • 3. Boat Owner agrees to have their boats insured with a minimum $500,000 per occurrence of liability coverage, listing the City of Silver Bay, Minnesota, as an additional insured. Boat Owner will be held responsible for all damage they or their boats may cause to other boats in the Marina, or to the structures or facilities thereof.
  • 4. Due to demand for Marina slips, all contracts are for a full season with NO REFUND for early termination.
  • 5. Marina reserves the right to designate all slip assignments. SLIP ASSIGNMENTS ARE NOT SUBJECT TO NEGOTIATION OR PERSONAL PREFERENCE OF BOAT OWNER. NO BOAT OWNER HAS THE RIGHT TO ASSIGNMENT OF A SPECIFIC SLIP DUE TO PRIOR USE OR ASSIGNMENT.
  • 6. Slip fees are per slip length and not boat length, with the exception of boats longer than 50 feet.
  • 7. Boat Owners will be assigned a slip that correlates to the size of their Boat. The length of a Boat will be determined from its outermost projection at the bow to its outermost projection at the stern, and not by the length of the hull.
  • 8. The Marina will test the water periodically for stray voltage. If any Boat is causing stray voltage, the Marina reserves the right to take all steps necessary to eliminate the stray voltage from the water.
  • 9. Bow pulpits or boat bows may not hang over the dock.
  • 10. Boat Owners may store one dinghy or PWC, 14 feet or less in length, on the dock where the Boat is moored. No such vessel shall be stored on the dock nor extend beyond 3 feet of the end of the dock. Any such vessel shall be registered in Boat Owner's name.
  • 11. The slip and Marina are to be used at Boat Owner's risk and Boat Owner assumes any and all risk of loss at the Marina. The Marina assumes no responsibility for, and Boat Owner will indemnify and hold Marina harmless from, the care, protection or security of the Boat.
  • 12. Alterations or additions to docks, slips, or other facilities may only be done by the Marina.
  • 13. The extent of boat repairs and maintenance permitted at dockside is at the discretion of the Marina. Generally, major repairs are not allowed. No outside contractors or service organizations or individuals will be permitted to undertake any work on boats in the Marina without the approval of the Marina. All approved contractors must provide proof of insurance acceptable to the Marina Manager before any work may commence. From Memorial Day to Labor Day, work that is noisy or disturbs other Boat Owners (as determined by Marina Manager) must be done between 8:00 a.m. and 5:00 p.m., Monday to Friday.
  • 14. Swimming, diving or fishing is not permitted in the Marina.
  • 15. Disposal of fish entrails is prohibited in all Marina refuse containers, dumpsters, and waters. Please use the provided fish cleaning station.
  • 16. Advertising or soliciting shall not be permitted in any part of the Marina.
  • 17. Courtesy carts are to be promptly returned to the head of the dock after use.
  • 18. Proper disposal of trash, waste and recyclables shall be done in accordance with all laws and ordinances. Use of trash and recycling containers provided by the Marina is required. Disposing of trash from off site is not permitted.
  • 19. Movement of boats within the Marina must be on a "no wake" basis.

    20. Fires are not permitted anywhere within the Marina.

    21. Parking of vehicles and trailers is at the risk of Boat Owner. Northshore Mining, the Marina and the State of Minnesota are not liable for damage, misuse, theft, or any other loss sustained by the Boat Owner, their guests or invitees, while parked on Marina property.

    22. One vehicle per Boat is allowed to use the "Permit only" parking lot. Additional vehicles must be parked in the middle parking lot. Parking in the "permit only" parking lot for more than 3 days in prohibited.

    23. Pets are permitted as long as they do not disturb others. They must be leashed at all times. Pet waste must be cleaned up immediately. Pets needing to relieve themselves should be walked in the designated dog walking area.

    24. Boat Owner, their guests and invitees, shall conduct themselves so as not to annoy, bother, or interfere unreasonably with the rights and privileges of other Boat Owner, their guests or invitees. Boat Owner is responsible for the conduct of their guests.

    25. Boat Owner may not sublet their slip nor may the slip be used by any individual or watercraft other than the Boat referenced in this license owned by Boat Owner.

    26. Marina reserves the right to use a slip when unoccupied by Boat Owner.

    27. Boat Owner must maintain their Boat in a neat, attractive and seaworthy condition, capable of operating under its own power.

    28. Boat Owner, their guests and invitees, agree to abide by all boating regulations of the United States, State of Minnesota and such rules and regulations of the Marina as may be established hereafter.

    29. "FOR SALE" (or equivalent) signs are not permitted to be displayed without prior approval by the Marina Manager.

    30. Charter boats operating out of the Marina must provide proof of Coast Guard license and liability insurance as required by County, State, and Federal regulations. Charters larger than six people not permitted without management approval.

    31. Fueling of boats other than as provided by the Marina is prohibited. Storage of fuel on the docks is prohibited.

    32. As of June 1, boats in dry storage that have not secured dockage at the Marina for the current season will be assessed additional storage charges at the rate of $7.50/ft + tax per month. After October 15th, boats not wintering in the Marina will be treated as transient and charged for the length of stay beyond the normal season.

    33. Discharge of toilet waste into Marina waters is prohibited.

    34. Proper use, cleanup and disposal of all boat maintenance products and waste are required. Disposal or discharge of such products onto the land or into the waters of the Marina is prohibited.

    35. All rigging and halyards shall be secured so as not to disturb other Boat Owners. Marina reserves the right to secure such rigging as necessary and to bill Boat Owner accordingly.

    36. The Marina is not responsible for any loss or damage for mail/packages delivered to the Marina.

    37. Camping within the Marina property is not permitted by Lake County Health Dept. regulations.

    38. Boat Owner agrees to comply with all posted rules and regulations as deemed necessary by Marina. 39. TERMINATION AND DEFAULT. This agreement shall remain in effect for one marina season, unless sooner terminted by the following conditions:

  • a. Destruction of the anchorage facilities by fire, storm, or other calamity.

    b. Sale of the Boat by Boat Owner.

    c. Default in any terms and conditions of this license agreement as set forth herein. Should Boat Owner default and breach any term or condition of this agreement or violate any posted rule or regulation, this license agreement will terminate immediately, and the Marina may take any action necessary to include, but not be limited to, retaking possession of the assigned slip by removing the Boat (to include removing the Boat from the water if necessary) at Boat Owner's risk and expense.

  • 40. BOAT OWNER RESPONSIBILITIES.

  • Marina expects Boat Owner to make suitable arrangements for safe, sheltered anchorage during storms, high winds, high or low water, ice or snow conditions and other bad weather, and Boat Owner warrants such arrangements have or will be made. Boat Owner may not assume that the Marina will be safe, sheltered anchorage at any time. In the event of an impending storm or other emergency, Boat Owner authorizes Marina to do whatever Marina deems appropriate to keep the Marina, Marina property, the Boat or other boats safe. These actions include but are not limited to moving the Boat at the Boat Owner's risk and expense. Marina is not required to do any act to save or preserve any Boat or Boat Owner's property. Boat Owner shall pay for all costs of such actions by Marina whether Marina's efforts are successful or not in protecting the Boat or Boat Owner's property.
  • 41. SALVAGE.

  • If the Boat sinks while in the Marina, Boat Owner shall raise the Boat at Boat Owner's sole cost and expense. If salvage is not begun within 24 hours after Boat Owner receives notice of the sinking, Marina may raise the Boat at Boat Owner's expense and dispose of it at Marina's discretion. Undertaking to move the Boat shall not be deemed an assumption of responsibility for the safety, security and care of the Boat by Marina, nor shall Marina be deemed a bailee of the Boat Owner. Marina shall have a federal maritime lien for salvage against the Boat for any and all salvage actions and costs undertaken by the Marina. Marina shall also have the contractual right to enforce its salvage costs and the amount of its salvage lien against the Boat Owner and/or Boat Owner's Agent or insurance policy.
  • 42. RELEASE OF LIABILITY AND ASSUMPTION OF RISK.

  • Boat Owner, and on behalf of their heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS NORTHSHORE MINING COMPANY, THE STATE OF MINNESOTA, DEPARTMENT OF NATURAL RESOURCES, AND THE CITY OF SILVER BAY, the owner, lessor and lessee of the premises known as Silver Bay Marina, their officers, officials, agents and/or employees ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE; except that which is the result of gross negligence and/or wanton misconduct. Boat Owner understands and agrees that this release of Liability covers all activities surrounding their use of the Silver Bay Marina and damage as the result of dust from the adjoining Northshore Mining Company facility.
  • I HAVE READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT INCLUDING THE "RELEASE OF LIABILITY AND ASSUMPTION OF RISK" AT PARAGRAPH 34. I FULLY UNDERSTAND MY RIGHTS AND RESPONSIBILITES INCLUDED IN THIS AGREEMENT.
  • I understand that it is my obligation to carry liability insurance on my Boat at all times
    during my seasonal slip rental. Marina has determined that the insurance requirement will
    be $500,000 minimum liability coverage.
