At Brien Real Estate Agency, we understand that pets are an important part of many households. We are not opposed to tenants having pets, however we are committed to ensuring all properties are protected and maintained to a professional standard. Our position is simple; we are pro-responsible pet ownership, not anti-pet. Tenants who wish to keep a pet must follow the correct process in accordance with the Residential Tenancies Act 2010 (NSW), including submitting a Pet Application Form and obtaining written consent prior to keeping any animal at the premises. Approval will be considered on a case-by-case basis, taking into account property suitability, strata bylaws (if applicable), and relevant local council regulations. Tenants remain fully responsible for: Preventing damage or nuisance caused by pets; Maintaining the premises in a clean, hygienic condition; and Covering the cost of any cleaning, repairs, or pest treatments required as a result of keeping a pet. Brien Real Estate Agency supports tenants who demonstrate responsible care for their animals and the property. Our aim is to maintain a safe, clean, and compliant environment for all occupants, owners, and their pets. Please read the Information below to ensure you understand your obligations & conditions of having a pet in a rental property: (Please note that these are general conditions and any specific conditions to a rental property will be outlined in the Residential Lease Agreement for further review prior to agreeing & signing a lease.) 1.All Pet/s MUST have an application form submitted and written approval from Landlords/Agents prior to the animal residing on the property. 2.The Pet/s may be given a specified area of the property and may be restricted from areas such as carpeted rooms. 3.The Pet/s must not cause a nuisance (including noise, odour, aggression, pests) to neighbouring properties. 4.The Tenant/s are solely responsible for their pet/s wellbeing and are to do their own research of boundary fences, disease/s and other items at the property. 5.The Tenant/s are responsible for providing a clean, faeces & debris free environment for their pet/s. 6.The Tenant/s are to ensure their pet/s comply with Local Council regulations including licensing, registrations etc. 7.The Tenant/s must ensure the property has been fumigated, carpets professionally cleaned, all hair / debris / faeces removed and any damages including smells are rectified to the condition of the entry inspection report. 8. The pet/s must be secured or restrained while any person authorised by our Agency is onsite. Stating ‘They won’t bite’ will not be accepted by our Agency under our Workplace Safety Policy. 9. If any person associated to our Agency becomes injured by an animal located at the property, we will be revoking any approval of the pet and it will be reported to the appropriate third parties such as Council immediately.

Agency Details & Privacy Statement
I confirm and understand that the information provided in this Tenancy Application is true and correct to the best of my knowledge and that this application is submitted to Property Owners / Agents. I understand that this application does not constitute a tenancy agreement and that approval is at the sole discretion of the landlord. I confirm that I have taken appropriate measures by physically inspecting, virtual inspection and/or a representative viewed on my behalf to ensure the property suits my needs and I accept the property’s condition & terms. If I have proceeded to apply & accept a property without personally inspecting it in person (“sight unseen”), I understand that by doing so, I accept the property in its current condition as represented by the information, photos, or virtual inspection provided. I agree that I am satisfied with the property as presented and that KACC Schneider Pty Ltd t/a Brien Real Estate Agency and the landlord will not be held responsible for any aspect of the property’s condition that I have not personally verified prior to signing the lease. I acknowledge that KACC Schneider Pty Ltd t/a Brien Real Estate Agency collects personal information necessary to assess my application, verify my identity, and determine my eligibility as a tenant. This information may include, but is not limited to, details relating to my identity, contact information, employment, income, rental history, referees, and any tenancy database records. In accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, I consent to KACC Schneider Pty Ltd t/a Brien Real Estate Agency collecting, using, and disclosing my personal information for the following purposes: To assess my tenancy application and verify the information provided; To communicate with referees, employers, and previous or current landlords/agents and other person deemed relevant to verifying information; To check my rental and tenancy history through approved tenancy databases such as TICA, NTD or TRA; To prepare and execute tenancy-related documents should my application be successful; To communicate through any means necessary with current/past landlords and agencies, tradespeople, emergency contacts, utility connection providers, insurance companies, NCAT, debt collection agencies, or other authorities as required to manage or enforce tenancy obligations; I understand that my personal information will be stored within databases which KACC Schneider Pty Ltd t/a Brien Real Estate Agency are subscribed to. To comply with obligations under the Residential Tenancies Act 2010 (NSW), Property and Stock Agents Act 2002 (NSW), and related legislation. I understand that if my application is unsuccessful, my information will be securely destroyed in accordance with privacy laws and the agency’s data retention policy. If my application is successful, I agree to enter into a Residential Tenancy Agreement with KACC Schneider Pty Ltd t/a Brien Real Estate Agency on behalf of the landlord and understand that: A non-refundable holding deposit may be required (up to one week’s rent), which will be applied to the first rent payment upon commencement of the tenancy; Should the non-refundable holding deposit not be paid within 48 hours of approval, the Agent / Landlord may withdraw my application; A bond equivalent to four weeks’ rent must be paid and lodged with the NSW Rental Bond Board before occupation. I understand that should the Tenancy change hands including to another Agency, the original documents and any other documents relating to the Tenancy will be given to the requesting party. I understand that I may request access to, or correction of, my personal information held by KACC Schneider Pty Ltd t/a Brien Real Estate Agency, subject to verification and legislative requirements. By signing this declaration, I consent to the collection, storage, and disclosure of my personal information as outlined above.
