Trefoil Academy, LLC ("Trefoil Academy") endeavors to provide a safe environment for you, your family, and your guests. Trefoil Academy provides exciting, life-enhancing programming that involves exercise, learning, and sports. Our summer camp ("Camp"), however, necessarily has a certain amount of risk associated with it. The purpose of this Agreement ("Agreement") is to secure your agreement to assume these risks, on behalf of yourself and any children or other minors for which you are legally responsible, and to ensure you are aware of and adhere to certain Trefoil Academy safety and other policies.

I acknowledge and agree that use of any of Trefoil Academy's facilities, services, equipment or premises (the "Facilities") necessarily involves risks of injury to my person and property, and to the person or property of any child or legal ward of mine (hereinafter "dependents") that I have requested or allowed entry to or use of the Facilities. By engaging in such use, or permitting use by a dependent, I voluntarily accept and assume full responsibility for these risks.

In consideration of the use of the Facilities and being permitted to participate in any way in any Trefoil Academy Camp, I agree that Trefoil Academy and its directors, officers, employees, volunteers, and agents ("Trefoil Academy") will not be liable for any injury to my person or property or to the person or property of any dependent of mine.

Further, on behalf of myself and my legal successors, I do hereby release, waive, discharge and covenant not to sue Trefoil Academy from any and all liability and claims arising from my use, or use of a dependent of mine, of the Facilities or participant in an Trefoil Academy Program ("Program") I further covenant not to sue Trefoil Academy with respect to, and I waive any and all claims that I may have now or in the future against Trefoil Academy for, any liability arising from the use of the Facilities. This waiver includes, but is not limited to, all liability and claims arising from personal injury (including death), property loss, economic loss, emotional distress, psychic injury, pain, suffering of any kind, damages, accidents or illness and damage to, loss of, or theft of property.

BY SIGNING AT THE BOTTOM OF THIS AGREEMENT, I ACKNOWLEDGE THAT I AM SIGNING THE AGREEMENT FREELY AND VOLUNTARILY, I UNDERSTAND I AM RELEASING TREFOIL ACADEMY FROM ALL LIABILITY TO ME, AND MY DEPENDENTS, FOR ANY AND ALL LOSSES AND DAMAGE TO ME OR SUCH DEPENDENT, AND I FOREVER GIVE UP ANY CLAIMS THEREFOR ON ACCOUNT OF INJURY TO PERSON OR PROPERTY TO THE FULL EXTENT ALLOWED BY LAW.

It is my responsibility, prior to engaging or permitting any of my dependents to engage in any Trefoil Academy program or other activity involving physical activity, to consult with my physician to determine whether I and my dependents are medically able to engage in the Program or activity. I give permission to any Trefoil Academy staff person to administer first aid in the event of an injury or illness. Additionally, I give permission to Trefoil Academy to administer first aid in the event of an emergency and to summon 911 response units for any medical treatment needed for me and my dependents. I agree that any medical expenses incurred by me or my dependents will be my responsibility.

Coronavirus, COVID-19, is an extremely contagious virus that spreads easily through person-to-person contact. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in Trefoil Academy programs or accessing Trefoil Academy facilities could increase the risk of contracting COVID-19. Trefoil Academy in no way warrants that COVID-19 infection will not occur through participation in Trefoil Academy programs or accessing Trefoil Academy facilities.

Based on currently available information and clinical expertise, people of any age who have serious underlying medical conditions might be at higher risk for severe illness from COVID-19. Trefoil Academy strongly recommends that you consult with your healthcare provider prior to coming into a Trefoil Academy facility, attending a facility-based program, or registering your child/dependent for a Trefoil Academy program or camp.

I understand the Trefoil Academy premises, especially parking lots and locker rooms (if applicable) are provided for guests' convenience while participating in the Programs. Trefoil Academy is not responsible for vandalism, break-ins, or thefts of personal property. I understand Trefoil Academy recommends that valuables should not be brought to program activities or onto any premises. I agree to report any suspicious activity immediately to the staff. I understand that it is my responsibility to request, read, and after enrollment, abide by the refund, cancellation and fee payment policies connected to specific Program involvement.

I and my dependents will not bring weapons (except those allowable by Trefoil Academy Policy Manual), controlled substances, or alcohol on Trefoil Academy premises. I understand that any form of solicitation is prohibited.

Engaging in behaviors such as violence, noise, force, coercion, sexual misconduct, threats, intimidation, unsafe actions involving children, fear, resistance, insults, or any other actions— whether intentional or unintentional—that disrupt or interfere with Trefoil Academy guests' enjoyment of program activities, or hinder staff, agents, or volunteers from performing their duties or conducting classes, is unacceptable. Such actions conflict with Trefoil Academy's values and may lead to the withdrawal or termination of my or my dependent's participation in the program.

I am aware that Trefoil Academy reserves the right, within its sole discretion, to withdraw program involvement to anyone for any reason that Trefoil Academy, in its sole discretion, considers appropriate or in the interests of Trefoil Academy.

Trefoil Academy conducts regular sex offender screenings on all participants and guests. If a sex offender match occurs, Trefoil Academy reserves the right to end program participation and remove visitation access.

I authorize the use and reproduction of any and all photographs or video footage of myself or my dependents for Trefoil Academy promotional purposes without compensation. If I wish to opt out of this release, I will complete the Photo Opt Out Release document located at: https://form.jotform.com/253407018543049

If a court determines that any provision of this Agreement is overly broad or otherwise unenforceable as written, the parties authorize such court to modify and enforce such provision to the extent the court deems reasonable. If any provision of this Agreement is found by a court to be overbroad and unenforceable and not capable of modification, it shall be severed, and the remaining covenants and provisions enforced in accordance with the tenor of the Agreement. By signing at the bottom of this Agreement or electronically accepting this Agreement, I agree that I have read this entire Agreement and understand my responsibilities, and those of my dependents, for participation and conduct in Trefoil Academy Camp programs and activities.
