Release of Liability

 

I acknowledge that TOCA is organized and always maintained  with the students’ safety and security a top priority, but accidents may happen. I understand that playgroup is held outside in a public park and that my child will be participating in physical outdoor activities (incl. running & climbing),  which may involve wood branches, sticks, stones and earth.

Regardless of any steps taken by TOCA to reduce the risks associated with outdoor activities, I knowingly and freely, assume all such  risks, both known and unknown, relating to my child’s care at TOCA.

In consideration of TOCA accepting this registration and  permitting the participation  of the above named child in such  activities, which I believe to be  educational, on behalf of myself and  my family, I hereby release, discharge, indemnify and hold harmless TOCA, its employees, representatives and agents from any and  all claims,  actions and  liabilities arising out of or in connection with the above named child’s participation in any aspect of the activities provided, even in the  case of TOCA's negligence.

TOCA encourages all children and parents to adhere to all safety and health guidelines, as outlined  in TOCA’s Summer 2026 guidelines.

Payment & Refund Policy

 

1. Payment Terms

A full or partial payment is required and due upon execution of this agreement.
 •  Tuition under $1,600: Must be paid in full at the time of enrollment.
 •  Tuition $1,600–$2,400: May be paid in two installments.
 •  Tuition above $2,400: May be paid in two or three installments.
The remaining balance (if any) is due in full by May 1, 2026, unless a different due date is specified on the invoice.

 

2. Cancellation & Refund

Cancellation at least 66 days before Summer 26 starts (Deadline May 1, 2026)
 •  If tuition was paid in full at enrollment: A 50% refund of the total payment will be issued, minus card processing fees.
 •  If tuition was paid via installment (split payment): No refund will be issued.
No additional payment is required.

Cancellation fewer than 66 days before Summer 26 starts, or after the program begins
 •  Full tuition is due.
 •  No refunds (including deposit or any installment paid) will be issued.
 •  No credits will be issued for future TOCA programs.

 

*** Important note: Processing fees are no longer refunded to us in the event of a cancellation or charge reversal. As a result, any approved refund will be issued minus applicable processing fees, unless the refunded amount is applied as a credit for future TOCA programs. Processing fees are generally 2.9% + $0.30.****

FYI - unlike credit card payments, ACH Bank Transfers don't generate instant payment receipt as they take 3-5 days to clear. 

Media Release

 

Photographs and videos are an essential part of TOCA; they help document the work we do and are important for all parents, new, current, or past, to get an idea of our work, the environment the children are in and their daily activities.

I do hereby consent and agree that TOCA has the right to take pictures and short videos of my child and use them on their own website and social media accounts without compensation. My child’s name and identity will not be revealed.

Enrollment & Participation

 

By enrolling my child in the TOCA Summer 25 program and remitting tuition fees, I acknowledge that participation equates to a membership arrangement, wherein regular attendance is expected. I understand that unforeseen circumstances such as inclement weather, illness or travel may occasionally prevent attendance. Our program operates on the understanding that tuition fees secure a place for the enrolled child, and the program incurs costs and commitments based on this enrollment. Therefore, missed days due to illness, travel, weather, scheduling conflicts, or other personal reasons do not qualify for credits or refunds. We will offer make up sessions due to inclement weather cancellations. We will not offer make up sessions for days missed due to travel, scheduling conflicts, or any other personal reasons. Please read the guidelines for specific information.
