1. Release and Waiver of Liability.
This agreement serves to release, the National Building Museum, the United States Government, Frontrunner Productions, Inc, Downtown DC BID, and the employees, representatives, and agents of the foregoing (collectively referred to as “‘Releasees”’) from any and all liability, including but not limited to liability for personal injury, property damage, or wrongful death, arising from or related to my participation in the activity, whether caused by the ordinary negligence of the Releasees or others. I understand this release does not extend to gross negligence, intentional misconduct, or willful disregard of safety caused by a third-party.
2. Assumption of Risks.
I understand and acknowledge that participation in synthetic ice skating and related activities involves inherent risks, including but not limited to slips, falls, collisions with other participants or objects, equipment malfunctions, and other hazards that may result in bodily injury, partial or total disability, or, in extreme circumstances, death. These risks are inherent to the activity, may result from my actions or inactions, the actions or inactions of others, or the conditions of the facilities or equipment provided. I voluntarily accept and assume all such risks, both known and unknown, even if arising from the negligence of the Releasees or others.
3. Parental/Guardian Consent for Minors under 18 years of age.
I, as a person over the age of eighteen (18), have full authority and consent to enter into this Waiver and Release of Liability on behalf of the subject minor participant. I, as the parent or legal guardian of the minor participant, acknowledge and agree to the terms of this waiver and release on behalf of the minor. I understand that by signing this agreement, I am waiving the minor’s and my own right to bring any claims against the Releasees for ordinary negligence arising from the minor’s participation in the activity. I further assume all risks, known and unknown, on behalf of the minor.
4. Indemnification.
I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, demands, actions, or causes of action, including attorney’s fees and costs, arising out of or in connection with my participation in the activity or the participation of any minor for whom I am responsible. This indemnity obligation includes claims resulting from my own conduct or the conduct of the minor under my supervision, except in cases of gross negligence or intentional misconduct by the Releasees.
5. Media Release.
I waive any right to inspect or approve the final versions of the photographs, videos, or other media, or the manner in which they are used, whether alone or in conjunction with other materials, to include any promotional materials. I agree that no further permission is required, and I will not receive any compensation for such use.
6. Severability.
If any provision of this Waiver and Release of Liability is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions, which shall remain in full force and effect.
7. Notice of Voluntary Participation.
I acknowledge that my participation in this activity is purely voluntary, and I am under no obligation to participate. I further understand that I am free to stop participating at any time without penalty.
8. Emergency Medical Treatment Authorization.
I authorize the Releasees to obtain medical treatment for me in the activity of an emergency, injury, or illness during the activity. I agree to be responsible for any costs associated with such treatment, and I will not hold the Releasees responsible for any medical treatment and/or the care and results associated therewith.
9. Acknowledgment of Understanding.
I certify that I have read this document in its entirety, fully understand its terms, and am signing it freely and voluntarily. I acknowledge that I am waiving significant legal rights, including the right to sue the Releasees for ordinary negligence.
10. Waiver.
THIS WAIVER INCLUDES A RELEASE OF CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF THE RELEASEES.
