BEYOND THE RANGE – LIABILITY WAIVER & TRAINING AGREEMENT

Firearm handling and firearm training involve inherent and serious risks, including but not limited to:

• Accidental or negligent discharge of a firearm
• Serious bodily injury, permanent disability, paralysis, or death
• Hearing damage, eye injury, burns, cuts, or other physical injury
• Emotional distress, fear, or stress reactions
• Ricochet, fragmentation, hot brass, or other projectiles
• Firearm, ammunition, or equipment malfunction or failure
• Unsafe conduct by another participant, instructor, or third party
• Property damage, loss, or theft

I understand this list is not exhaustive. I understand and voluntarily accept these risks and choose to participate.

In consideration for being allowed to participate in training conducted by Beyond The Range LLC ("Beyond The Range"), I release, waive, and discharge:

• Beyond The Range LLC
• Its owners, members, managers, employees, instructors, and contractors
• Any range, bay, classroom, or facility used for training

(together, "Released Parties") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, OR EXPENSES OF ANY KIND, WHETHER KNOWN OR UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH MY PARTICIPATION, INCLUDING CLAIMS BASED ON ORDINARY NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY LAW.

This release does not apply to gross negligence, recklessness, or willful misconduct, which remain governed by applicable law.

I agree to:

• Follow all range rules and safety instructions
• Follow all commands issued by Beyond The Range instructors
• Follow all commands issued by facility range safety officers
• Use required eye and hearing protection
• Handle firearms safely and maintain proper muzzle and trigger discipline
• Immediately report any injury, malfunction, near miss, or unsafe condition
• Comply with all federal, state, and local laws governing firearms

I will not engage in horseplay, threatening conduct, or reckless behavior while firearms are present.

I acknowledge that Beyond The Range instructors and facility range safety officers have authority over safety decisions during training. In their judgment, they may:

• Stop, pause, modify, or end training at any time for safety reasons
• Remove me from the range, bay, classroom, or facility
• Inspect or reject any firearm, ammunition, holster, or equipment
• Take reasonable action to protect me, other participants, or facility personnel

Safety decisions made during training are final.

I certify that:

• I am legally permitted to own, possess, and handle a firearm
• I am not subject to any court order, protective order, or law prohibiting firearm possession
• I am not under the influence of alcohol, marijuana, illegal drugs, or impairing medication
• I am mentally and physically capable of safely participating
• I will notify my instructor before training begins of any condition that may affect safe participation

I understand that:

• Only factory-new, brass-cased ammunition is permitted
• Reloaded, remanufactured, steel-cased, or surplus ammunition is prohibited
• I am responsible for the safe condition and legality of any personal firearm, ammunition, or equipment I bring
• Beyond The Range does not warrant or guarantee the safety, function, or reliability of participant-owned firearms or equipment
• Ammunition is not included in training sessions and must be purchased separately if needed.

I understand that:

• Training may take place at a facility that Beyond The Range does not own or operate (such as Main Line Armory)
• I agree to comply with all rules, policies, and requirements of the host facility
• If facility rules are stricter than Beyond The Range's rules, the facility's rules control
• Beyond The Range is not responsible for the independent acts, conditions, or policies of the host facility

I agree to indemnify and hold harmless the Released Parties from any costs, damages, claims, losses, or expenses arising out of or related to, in whole or in part:

• My own negligent, reckless, unlawful, or unsafe conduct
• My failure to follow safety rules, instructor directions, or facility requirements
• My firearm, ammunition, or equipment
• Injury or property damage I cause to another person, the facility, or Beyond The Range

This does not require me to cover a Released Party for liability caused solely by that Released Party's own conduct, where prohibited by law.

I authorize Beyond The Range instructors, facility staff, and emergency responders to seek emergency medical assistance if I become injured, ill, or incapacitated during or after training. I understand that:

• Beyond The Range is not obligated to provide medical care
• Any assistance provided is offered in good faith
• I remain responsible for medical, ambulance, and related costs
• My emergency contact information may be used if appropriate

I understand that Beyond The Range does not guarantee:

• Improved performance, a specific skill level, or firearm proficiency
• Approval for any license, permit, certification, or employment qualification, including a state's Concealed Carry Deadly Weapons (CCDW) license or Permit to Purchase, which the issuing state decides
• My legal compliance regarding firearm possession, storage, transport, or concealed carry

Beyond The Range does not provide legal advice. I am responsible for consulting a licensed attorney for legal questions.

I understand and agree that:

• All services must be paid in full at booking
• There are no refunds, under any circumstance
• Reschedules 48+ hours before the session transfer 100% of my payment
• Reschedules under 48 hours result in 50% forfeiture to cover facility charges
• No-shows result in full forfeiture
• Additional rentals, extra time, or add-on services selected at or after booking are subject to these same terms

Beyond The Range may photograph, video, or audio record portions of training for safety review, instructor feedback, and quality assurance. This is separate from marketing use.

Unless I select otherwise below, my image will not be used for marketing, social media, or promotional material.

I understand I may request deletion of training-purpose recordings in writing, and Beyond The Range will honor reasonable requests unless the recording is needed for safety, legal, or insurance purposes.

Guardian certifies:

• They will be present for the entire training session
• They assume full responsibility for the minor participant's conduct
• They accept all risks listed in this agreement on behalf of the minor
• They authorize emergency medical assistance for the minor if needed
• They agree to release, indemnify, and hold harmless Beyond The Range and the Released Parties from claims arising from the minor's conduct or participation

This Agreement is governed by the laws of the Commonwealth of Pennsylvania. If any part of this Agreement is found unenforceable, the remaining parts stay in effect.

This Agreement covers all training sessions between Participant and Beyond The Range for twelve (12) months from the date of signature below, unless earlier revoked in writing by either party or superseded by a new signed agreement. Beyond The Range may require a new signature at any time, including before any session, at its discretion.

This Agreement represents the entire understanding between Participant and Beyond The Range regarding training risks and liability, and replaces any prior discussion or agreement on this subject. Section headings are for convenience only and do not limit or affect interpretation of this Agreement. Beyond The Range's failure to enforce any provision of this Agreement at any time does not waive its right to enforce that or any other provision later.

By signing below, I certify that:

• I have read this entire agreement and understand its terms
• I am signing voluntarily
• Each section acknowledged above is individually binding
• This electronic signature is legally binding under the federal E-SIGN Act and Pennsylvania's Uniform Electronic Transactions Act
• Jotform will record the date, time, and method of my signature as part of this agreement
