     These two steps are TXSNOW’s “double reminder” to participants about the rescheduling/cancellation terms – especially this clause:


    “C. Rescheduling: If you need to change your lesson date/time, you must contact customer service more than 48 hours before the lesson.
    Changes made 48–24 hours before the lesson will forfeit 50% of the lesson fee.
    Within 24 hours, cancellations/changes are non-refundable.”

    Below is how this rule is interpreted at each stage.
     
    1. Participant contacts TXSNOW within 48 hours to reschedule/cancel
    When a participant reaches out to TXSNOW within 48 hours before the lesson asking to reschedule or cancel, TXSNOW must by default answer “no”. Once the participant has checked the agreement, the rescheduling/cancellation clause is already legally binding.


    Operational explanation:
    ·       This clause affects the rights and interests of three parties: participant, instructor, and TXSNOW.
    ·       TXSNOW cannot unilaterally override the agreed terms or make a change on the instructor’s behalf without consulting them.
    ·       From this point on, because TXSNOW is bound by the default contract terms, the actual decision on whether to allow rescheduling/cancellation within 48 hours is up to the instructor.

      2. Participant contacts the instructor directly within 48 hours (including in the lesson group)


    If the participant contacts the instructor privately or in the lesson group within 48 hours and the instructor agrees to reschedule/cancel, then:
    ·       The instructor informs TXSNOW that rescheduling/cancellation is approved.
    ·       In that case, no late-cancellation fee will be charged to the participant.


    Operational explanation:
    ·       Once a lesson is confirmed, TXSNOW treats the instructor as being on the front line with the participant.
    ·       TXSNOW therefore delegates the final decision on rescheduling/cancellation within 48 hours to the instructor who is directly dealing with the participant, so that they can make the most reasonable decision for all three parties.
    ·       From this point onward, the instructor’s decision takes priority over the standard rescheduling/cancellation clause in the participant agreement.


    Following the principle that rights, responsibilities, and obligations should match, once you as the instructor hold this decision-making power, you also have a duty to make sure the participant knows or should reasonably know your position on rescheduling/cancellation.


    That is why:
    ·       You must post the “TXSNOW Lesson Purchase & Service Agreement – Reminder” (see Attachment at the end of this document) in the lesson group.
    ·       This post is part of how you protect your own rights: it re-states your position, reminds both participant and instructor to follow the agreement, and clearly signals that from this point on, any rescheduling/cancellation will be handled according to your decision as the instructor, as first priority.

    Additional implementation rules for rescheduling/cancellation


    1. Posting the reminder in every confirmed lesson group
    In any group where a lesson has been confirmed, the instructor should post the “TXSNOW Lesson Purchase & Service Agreement – Reminder” as soon as possible to make their position clear, and to ensure the participant has seen (or should reasonably be deemed to have seen) the key terms.


    ·       If the instructor does not post this reminder, it will be treated as the instructor not explicitly asserting their right to enforce the 48-hour rule.
    ·       In that case, the participant may reschedule/cancel within 48 hours without being charged, even if they do so without the instructor’s consent.

    2. When there are multiple instructors in the same group
    If there are multiple instructors in the same group:


    ·       Once Instructor A has posted the reminder, other instructors do not need to copy-paste the same text again.
    ·       However, other instructors must reply to that reminder with something like “Agreed” or “Seconded” to formally record that they adopt the same position.


    If an instructor does not reply to indicate agreement (“seconded / noted / agreed” etc.), that instructor will be treated as having allowed the participant to reschedule/cancel within 48 hours without being charged.

    3. Participant reschedules/cancels within 48 hours after the reminder / “seconded” message


    If the reminder has been posted in the group, or another instructor has clearly replied “seconded / agreed”, and the participant then reschedules/cancels within 48 hours, the system will treat this as:


    ·       The participant is automatically charged according to the agreement.
    ·       The instructor does not need to inform the participant again that a fee has been charged.
    ·       The instructor will be paid the same amount as if the lesson had taken place.

    4. Instructor chooses to waive the fee even after posting the reminder


    If the reminder has been posted (or “seconded”) and the participant still asks to reschedule/cancel within 48 hours, but the instructor decides, for any reason, to allow it without penalty, then:


    ·       The instructor should clearly state this in the group (e.g. “I understand your situation, I agree to reschedule/cancel without fee”).
    ·       In that case, no late fee will be charged for that participant’s last-minute rescheduling/cancellation.

     “TXSNOW Lesson Purchase & Service Agreement – Reminder”

    Dear participant,


    1.     Please complete the Waiver and pre-lesson information form before your lesson (using your legal name; each person must complete them for their first lesson of each season). You must complete these forms before the lesson can start.
    2.     If a participant is under the influence of alcohol or drugs, or refuses to wear a helmet, the instructor may refuse or terminate the lesson.
    3.     If you need to buy a lift ticket or rent equipment, please finish these before your lesson start time and arrive at the resort at least 1–1.5 hours early (and 2–3 hours on weekends/holidays due to higher volume). If you are not ready on time because tickets/rentals are not done, lost time will not be refunded or made up.
    4.     Please be on time. Arrive at the meeting point 10–15 minutes early. If you are late, or need to stop the lesson due to injury, illness, or needing medical care/rest, any lost lesson time is non-refundable and will not be made up. If the instructor is late for any reason, they will compensate you with double the time.
    5.     Rescheduling / cancellation:
    - If you need to change your lesson date/time, you must contact customer service more than 48 hours before the lesson.
    - Changes made 48–24 hours before the lesson will forfeit 50% of the lesson fee.
    - Within 24 hours, cancellations/changes are non-refundable.
    - Lessons purchased within 48 hours of the scheduled start (including same-day purchases) cannot be changed or cancelled.
    - If the resort is officially closed due to extreme weather, lessons can be rescheduled.
    6.     For 1:x lessons (including 2:4 dynamic group lessons), if another person is injured and the instructor must accompany them for medical care / incident handling, the lesson is paused immediately. Any lost lesson time in this situation is non-refundable and will not be made up.
    7.     Kids Master Program:
     Parents must set a Pickup Code for their child and, before the end of the lesson, enter this Pickup Code on the web page provided by the instructor in order to pick up the child.
    - Please arrive at the meeting point 15 minutes before the end of the lesson to pick up your child. If a parent is late, additional time will be charged at the Snow Buddies Discovery Program rate.
    8.     Kids Master Program – teaching approach:
     - Kids Master lessons apply a Montessori-inspired, child-led approach to skiing. Lesson content will be adjusted dynamically based on the child’s state.
    - If the child shows signs of emotional distress, discomfort, fatigue, or abnormal temperature, or is otherwise not fit to continue, the instructor may, based on safety and professional judgment, immediately switch the lesson into a Snow Buddies Discovery Program-style low-intensity, play-based session without needing prior parental consent, and will notify the parent as soon as reasonably possible.
    -  If the child still refuses to continue or is assessed as unfit to continue, the instructor will not force them to ski, and will contact the parent to confirm whether to end the lesson. Any remaining time will not be refunded or made up.
