Terms and Conditions
Loan of Artwork
The Artist, identified above, agrees to loan his/her/their sculpture or 2D artwork to the City of Ivins for a one-year period running from May 2026 through April 2027 (“Display Period”). During this time, the artwork will be displayed by Ivins City and offered for sale. The Artist is solely responsible for setting the sale price.
Ivins City and its Arts Commission will market exhibited works and retain a 25% commission on any sale during the exhibit. Any purchaser of the artwork cannot take possession until after the Display Period.
Ivins City retains sole discretion in selecting artwork for exhibition and is under no obligation to display any submission. Ivins City appreciates the generosity of any artist who chooses to donate their work to the community at the end of the Display Period.
Artist Certifications
Artist resides in Ivins City, has a studio in Ivins City and/or their work is currently represented by a gallery located in Ivins City.
The Artist certifies that the piece:
- Meets required size parameters for 2D work to FIT in the following WALL SPACE dimensions:
- 30" (W) × 40" (H), or
- 48" (W) × 36" (H)
- For sculptures:
- Must be at least 36 inches in height and/or diameter, structurally sound, and sturdy enough to withstand public interaction, including children climbing on or touching the work;
- Must be free of sharp edges or other hazardous elements;
- Is constructed of durable materials able to withstand Southern Utah’s climate (20°F in winter to 115°F in summer)
- Includes a full presentation image if multiple pieces are submitted that fit within these dimensions;
- Is the original creation of the submitting Artist;
- Is visually engaging and appropriate for the Ivins City environment and diverse community;
- Demonstrates originality in design and content;
- Does not require electricity, water, audio/visual components, or other utilities;
- Meets public safety, structural, and maintenance standards;
- Complies with the Americans with Disabilities Act (ADA) and all other applicable laws, codes, and regulations and;
- Will not require regular maintenance during the Display Period.
Artist Responsibilities
The Artist is responsible for:
- Outdoor sculptures only: Securely attaching the artwork to a durable steel base or mounting plate suitable for welding to a metal or concrete pedestal. Assistance may be available from the Ivins Arts Commission;
- Transporting or shipping the artwork to and from designated locations within Ivins City; and
- Arranging any necessary storage before or after the Display Period.
Ivins City Responsibilities
Ivins City will:
- Install pedestals for selected artworks;
- Secure the artwork to the pedestal or otherwise install it at the selected site;
- Maintain property insurance for actual replacement value in the event of vandalism, theft, or accidental damage. This insurance is theArtist’s sole remedy, and the City shall not be liable for additional compensation; and
- Make reasonable efforts to market the exhibited artwork.
Ivins City Rights
Ivins City reserves the right to:
- Determine all installation and placement decisions; and
- Make emergency repairs/removal deemed necessary.
Permissions
The Artist grants Ivins City and its Arts Commission permission to use the Artist’s name and to photograph the Artist and/or artwork for use on the Ivins City and its Arts Commission websites, community informational materials, and other media to promote Art on Loan.
Acknowledgment of Risk
The Artist understands that Ivins City and its Arts Commission will take reasonable care to protect the artwork while it is in their custody; however, the artwork is submitted at the Artist’s own risk. The Artist acknowledges that, if selected, the art installation constitutes public art promoted by Ivins City as government speech, and may be removed at any time at the City’s sole discretion.
