agree for myself and (if applicable) for the members of my family and guests, to the following:
1. AGREEMENT TO FOLLOW DIRECTIONS:
I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by ROGERS ARKANSAS GUN CLUB INC., or its officers, representatives, or agents.
2. ASSUMPTION OF RISKS & RELEASE:
I recognize that there are inherent risks associated with the activities I am participating in. I assume full responsibility for any personal injury to myself and, if applicable, my family members. I further release and discharge ROGERS ARKANSAS GUN CLUB INC. (RGC), its Members, Directors, Agents, Officers, Employees, and Volunteers from any injury, loss, or damage arising out of my or my family’s participation in activities organized by RGC, whether caused by the fault of myself, my family, RGC, or any third parties.
3. INDEMNIFICATION:
I agree to indemnify, hold harmless, and defend ROGERS ARKANSAS GUN CLUB INC., its Members, Directors, Agents, Officers, Employees, and Volunteers against all claims, causes of action, damages, judgments, costs, or expenses—including attorney fees and litigation expenses—which may arise from my or my family's participation in activities organized by RGC.
4. FEES:
I agree to pay for all damages to the facilities or property of ROGERS ARKANSAS GUN CLUB INC., or its partners, caused by any negligent, reckless, or willful actions by me, my family members, or my guests.
5. APPLICABLE LAW:
Any legal or equitable claim that may arise from participation in RGC activities shall be resolved under Arkansas law.
6. NO DURESS:
I acknowledge that I am under no pressure or duress to sign this Agreement and that I have had a reasonable opportunity to review it prior to signing. I understand that I may consult legal counsel regarding this Agreement if I wish.
7. ARM’S LENGTH AGREEMENT:
This Agreement and each of its terms are the product of an arm’s length negotiation between the Parties. Should any ambiguity arise in interpreting this Agreement, the Parties expressly reject any legal rule that would construe the language for or against either party based on authorship of the document.
8. ENFORCEABILITY:
The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of the remaining provisions. Any invalid or unenforceable provision shall be deemed removed without affecting the remainder of the Agreement.
9. COMMUNICATION CONSENT:
By submitting your information, you agree to our Terms and Conditions and expressly consent to RGC and its selected partners contacting you—through automated or prerecorded means—via telephone, mobile device (including SMS/MMS), or email, even if your number appears on a corporate, state, or national Do Not Call Registry.
10. PHOTOGRAPHY, VIDEOGRAPHY & RECORDING:
I acknowledge and understand that my actions while on the property may be recorded by video and/or audio surveillance systems. I grant permission for photographs and video of me to be used in electronic and print advertising. I understand that I may revoke permission for advertising use of my likeness by submitting a signed written notice stating that my likeness may no longer be used. I further understand that revocation of advertising permission does not apply to security or surveillance recordings.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS. I AGREE THAT TYPING MY NAME OR SIGNING ELECTRONICALLY BELOW CONSTITUTES MY LEGAL SIGNATURE AND HAS THE SAME FORCE AND EFFECT AS A HANDWRITTEN SIGNATURE.
