Key Insurance Points for Instructors (Binding Summary)
- Insured status & scope of coverage:
Instructors are only deemed covered when contracted Instructors are delivering a confirmed TXSNOW Lesson (at the agreed time, at an approved venue, and in compliance with TXSNOW policies), and only within the scope allowed under the policy’s “contracted personnel extension”. Activities outside this scope (such as private lessons, or teaching at unapproved times/locations) are not covered.
- Purpose of the CGL:
The CGL protects TXSNOW operations in Canada against third-party bodily injury and property damage. The limit is CAD $10,000,000 per occurrence, subject to all terms, conditions, exclusions, and the deductible.
The CGL is not personal medical/accident insurance, work injury/WSIB coverage, or insurance for personal equipment.
- Common exclusions (not covered):
(i) The Instructor’s own injuries or illness (please arrange your own medical/accident insurance);
(ii) Loss of or damage to personal equipment;
(iii) Liability arising from driving your own vehicle, or vehicle use beyond the policy’s “non-owned/hired auto (excess)” provision;
(iv) Activities that are not part of a confirmed Lesson, or that violate resort rules or ignore ski patrol instructions;
(v) Situations involving alcohol, cannabis, illegal drugs, or intentional / grossly negligent acts;
(vi) Lift ticket / pass violations;
(vii) Money judgments under U.S. jurisdiction, and excluded cyber / data-related liabilities.
- Safety and cooperation duties:
(i) Helmet use is mandatory;
(ii) Organize and ensure participants sign waivers and informed consent as instructed;
(iii) Incident reporting: any injury, collision, or near-miss must be reported to TXSNOW within 2 hours after the Lesson;
(iv) Preserve facts and evidence, record witness information, and contact ski patrol / first aid immediately;
(v) Do not admit liability, make promises, or privately settle — all matters must be referred to TXSNOW;
(vi) Cooperate with the insurer/adjuster’s investigation;
(vii) Transportation & carpooling: TXSNOW does not provide or require transportation. Instructors must notinclude transporting participants as part of the service, and must not provide / solicit / organize / carry out rides during Lesson time.
If an Instructor and an adult participant independently arrange carpooling outside TXSNOW, this falls outside the scope of this agreement, and all risks are borne by the parties themselves.
For clarity: TXSNOW’s CGL does not cover any risk related to the Instructor’s own vehicle.
- Certificates & Additional Insureds:
Resort operators and similar parties are usually listed as Certificate Holders on insurance proof; this does notmean they are insured. Only entities explicitly named in the policy as Additional Insureds enjoy related coverage. Activities by the Instructor that are unrelated to TXSNOW are not covered.
- Deductible & recovery:
The deductible is handled centrally by TXSNOW. However, if a loss arises from an Instructor’s intentional misconduct or serious breach of obligations, TXSNOW may, within the limits of applicable law, seek recoveryfrom the Instructor.
