RELEASE AND WAIVER OF LIABILITY, AUTHORIZATION, AND INTELLECTUAL PROPERTY AGREEMENT

I, the undersigned, being the parent, legal guardian, adult participant, volunteer, vendor, or authorized person involved in a Donald Brown Developmental League youth program, community outreach event, fishing event, sports program, summer program, or related activity, including but not limited to the “Fishing with Kids & Parents” event, collectively referred to as the “Program” or “Event,” understand and agree to the following:

In consideration of my participation or the participation of my child, minor participant, or any participant listed under my registration, I hereby release, defend, indemnify, and hold harmless Donald Brown Developmental League, a 501(c)(3) nonprofit organization, its directors, officers, board members, employees, contractors, volunteers, agents, representatives, invitees, sponsors, partners, affiliates, and program representatives, collectively referred to as the “Donald Brown Developmental League Group,” from and against all liability, claims, losses, damages, costs, expenses, attorney’s fees, demands, suits, and causes of action of every kind arising from personal injury, death, illness, accident, property damage, or any other harm connected to participation in the Program or Event.

I understand that participation in Donald Brown Developmental League programs and events may include outdoor activities, recreational activities, sports activities, fishing, activities near water, community events, movement-based activities, interaction with other participants, vendor activities, volunteer activities, and other related program activities. I acknowledge that these activities may involve risks, including but not limited to slips, falls, cuts, scrapes, insect bites, sun exposure, dehydration, contact with fishing equipment, hooks, bait, water-related hazards, weather-related risks, contact with other participants, and other known or unknown risks.

I understand that participation is voluntary. I voluntarily assume all risks associated with my participation or the participation of my child, minor participant, or any participant listed under my registration.

I certify that I am the parent, legal guardian, adult participant, volunteer, vendor, or authorized person signing this agreement. I certify that I have the legal authority to sign this agreement on behalf of myself and/or the minor participant(s) listed on this form.

I understand that Donald Brown Developmental League does not provide medical insurance for participants, volunteers, vendors, parents, guardians, or attendees. I understand that I am responsible for any medical expenses, emergency care, treatment, or related costs that may arise from participation in the Program or Event.

In the event of an emergency, I authorize Donald Brown Developmental League representatives, volunteers, staff, or emergency personnel to seek medical assistance for me, my child, or any participant listed under my registration if deemed necessary. I understand that every reasonable effort will be made to contact the emergency contact listed on this form.

I, the authorized person signing, grant Donald Brown Developmental League and its representatives the right to take, edit, use, publish, and distribute photographs, video, audio, or digital media of me, my child, or any participant listed under my registration for lawful promotional, educational, marketing, fundraising, grant, sponsor, website, social media, and nonprofit communication purposes without payment or other consideration. This authorization continues indefinitely unless revoked in writing. If revoked, media captured after the date of written notice will not be used. Media captured before written notice may continue to be used and will not be required to be removed.

All intellectual property, including designs, logos, flyers, graphics, uniforms, program materials, marketing materials, event concepts, photos, videos, and related creative materials created by or for any executive, board member, coach, staff member, volunteer, contractor, sponsor, partner, vendor, or representative under the auspices of, on behalf of, in conjunction with, or for the benefit of Donald Brown Developmental League shall be the property of Donald Brown Developmental League from the time of creation and in perpetuity, unless otherwise agreed to in writing.

Any materials intended for use on behalf of Donald Brown Developmental League, including but not limited to designs, logos, flyers, graphics, uniforms, program materials, marketing materials, event concepts, photos, videos, and related creative materials, must receive prior approval from Dr. Donald Brown at 832-264-0122 before creation, publication, production, or distribution.

I understand that Donald Brown Developmental League is a 501(c)(3) nonprofit organization that provides youth programs, mentorship programs, fishing with kids programs, community outreach events, children’s education programs, and youth sports programs. I understand that participation in any Donald Brown Developmental League program or event is voluntary.

BY SIGNING BELOW, I CONFIRM THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, AUTHORIZATION, AND INTELLECTUAL PROPERTY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, AND SIGN IT FREELY AND VOLUNTARILY. I INTEND MY SIGNATURE TO SERVE AS A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
