Release of Liability and Consent Form

I, the undersigned, as the parent or legal guardian of the child named below, give my full consent for my child to participate in Pitching with Dana, LLC lessons, clinics, practices, and events. I understand that there are certain risks of damages and injuries inherent in the practice and play of softball, and I am willing to assume all risks on behalf of my child, myself, and any family members involved with catching the pitching lesson. These risks include, but are not limited to, those hazards associated with equipment, facility property, and other participants. I agree with and consider the following when I allow my child to participate in Pitching with Dana, LLC paid or free events, services, and programs: 1. On behalf of my child and myself, I do voluntarily assume all risks of injury incurred or suffered by my child, myself, and any family members (a) while practicing on Dana Reiss' property or Detroit Prospects Center or facility field where an event is being held (b) while serving in a non-playing capacity as a participant or observer during practice or play by other participants (c) while being trained by Dana Reiss, one of her clinic helpers, or Intern Coaches. 2. The risk to have contact with individuals who have been exposed to and/or have been diagnosed with an infectious disease, including but not limited to COVID-19, exists. I fully understand that it is impossible to eliminate the risk entirely and accept that I or my child could be exposed to and/or become infected through contact with or close proximity with an infected individual.

3. In addition to giving my full consent for my child's participation, I do hereby waive, release, discharge and agree not to sue or press legal action on Dana Reiss or family members, Pitching with Dana, LLC, the owner or operator of any field or facility, or any person/entity connected with Pitching with Dana, LLC, for any claim, damages, costs including attorney fees, or cause of action which I or my child have or may have in the future as a result of damages, injuries, including death, sustained or incurred by my child from whatever cause including, but not limited to, the negligence, breach of contract or wrongful conduct of the parties hereby released. 4. I hereby grant Dana Reiss, Pitching with Dana, LLC, and Intern Coaches the absolute right and permission to use photos, digital images or video of my child, or in which My Child may be included in whole or part, or reproductions thereof in color or otherwise for any lawful purpose whatsoever, including but not limited to use in any promotional documents or social media platforms without payment or any other consideration. I also understand and accept that anyone on Dana Reiss' property/premises is being recorded via a video surveillance system. 5. I have read and fully accept the rules of Pitching with Dana, LLC. My child under the age of 18 will always be supervised by an adult while on Dana Reiss' premises. Owner and facility associates have the right to restrict usage, participation or involvement of Pitching with Dana, LLC services, events, and property based on inappropriate behavior; including but not limited to, breaking an established rule, misuse of property and equipment, and violence or inappropriate behavior towards another customer or trainer. I hereby certify that my child is fully capable of participating in the sport of softball and that my child is healthy and has no physical or mental disabilities or infirmities that would restrict full participation in these activities conducted on Dana Reiss' / Pitching with Dana, LLC premises. I acknowledge (a) that I have read (or have had read to me) each and every one of the provisions in this waiver, release of liability and indemnification agreement, (b) that I understand each of the provisions in this agreement and (c) that I agree to abide by them.
