In consideration for my or my minor's allowance to use Choice Fitness on a guest basis during Family Swim, I hereby stipulate and agree:
1. That I realize the risks of cardiovascular exercise, weight lifting, weight training, bodybuilding, sports training, recreational sports, swimming, and/or general physical activity and I am fully aware of the possibility of mechanical and/or other malfunctions of cardiovascular, weight machines, weight machines and apparatus, sports equipment, and/or pool equipment ("equipment") due to the negligence of Choice Fitness or otherwise, as well as the possibility of injury to my person or my minor(s) as a result of the use of such cardiovascular equipment, weight machines, weight machines apparatus, and/or sports equipment, and/or pool equipment. I, therefore fully understand and I am mindful of the serious consequences which might result due to my or my minor's involvement in cardiovascular exercise, weight lifting, weight training, bodybuilding, sports training, recreational sports, swimming, and/or general physical activity while on Choice Fitness premises and based on the understandings, as set forth in this paragraph, I voluntarily assume any and all risk of loss, damage or injury of any kind whatsoever from my or my minor's use of any and all of the equipment and facilities of Choice Fitness, or their respective trustees, beneficiaries, staff, officers, directors, shareholders and agents from my or my minor's use of Choice Fitness and its equipment and facilities.
2. That my minor(s) and I are physically sound and have medical approval to proceed with a normal routine of exercise and/or activity. That any and all exercise shall be undertaken by my minor(s) and me at my sole risk. That my minor(s) and I are in good health and have no physical condition that would be aggravated by our involvement in cardiovascular exercise, weight lifting, weight training bodybuilding, and/or sports training, recreational sports, swimming, and/or general physical activity, nor do my minor(s) and I have any physical limitations that would preclude said involvement.
3. That I am forewarned that Choice Fitness will not in any event provide medical and/or hospitalization insurance for my minor(s) and my benefit and in the event of any injury to my minor(s) and my person occurring either as a result of my minor(s) and my being on any portion of the premises of Choice Fitness. I will save harmless and keep indemnified Choice Fitness and their respective trustees, beneficiaries, staff, officers, directors, shareholders, and agents from any and all actions, claims, costs, expenses or demands, in respect of such injury or injuries, including death, howsoever caused, arising out of or in connection with my minor(s) and my use of Choice Fitness or my minor(s) and my being on any portion of said premises and notwithstanding that the same may have been contributed to or occasioned by the negligence of Choice Fitness, and their respective staff, representatives, agents, officers, directors, shareholders, trustees or beneficiaries.

4. That my minor(s) and I will abide meticulously by each and every of the Choice Fitness rules and regulations and I further agree that if my minor(s) and I derogate from abiding by the same, that Choice Fitness and its staff shall have the right at anytime, which in their sole and absolute discretion may see fit, to cancel my membership or revoke my guest privileges. I certify that I am the parent or legal guardian of the listed minors and confirm that the information I entered is accurate and true. I am at least 18 years old.

ACKNOWLEDGEMENT: Having read the above terms, I intend to be legally bound hereby and understand this agreement to be a complete waiver and disclaimer in the favor of Choice Fitness, of any and all liability, I hereby affix my signature hereto

*Please note only 2 children are allowed per adult member at Family Swim. The additional spaces are to allow for a parent/guardian to complete one waiver for multiple children.
In addition to the above waiver, I agree to abide by the Family Swim Guidelines as follows:
- Family Swim is open to Silver Members at their home club (if there is a pool). Family Swim is open to Elite Members at all locations with pools. Family Swim is a free amenity.
- Each Adult Member (18+) can bring in a maximum of 2 guests under the age of 18 for free during the designated Family Swim time.
- Each non-member must have a guest waiver completed by their parent or guardian.
- There is NO Lifeguard on Duty, and the member is required to be in the pool with their guests the entire time.
- Please abide by all posted pool rules.
- Family Swim times vary by location and are subject to change, so please check with the club for availability. Some locations do require reservations.
