This Waiver of Liability and Release Agreement ("Agreement") is between Our Creative Clubhouse ("the Clubhouse") and the undersigned participant or parent/guardian ("Participant").
By signing this Agreement, the Participant acknowledges and agrees to the following:
1. Assumption of Risk
The Participant understands that the Clubhouse offers creative activities involving art materials (e.g., paints, glue, scissors, clay, markers, and other tools), which may involve inherent risks, including but not limited to:
- Cuts, scrapes, or punctures from tools.
- Allergic reactions or skin irritation from materials.
- Eye injuries (e.g., from splashes or flying debris).
- Slips, trips, or falls unrelated to play structures.
- Ingestion or misuse of non-toxic (but not edible) materials.
The Participant voluntarily assumes all risks associated with these activities.
2. Release of Liability
The Participant hereby releases, waives, and discharges the Clubhouse, its owners, employees, and affiliates from any and all claims, liabilities, or damages (including legal fees) arising from participation, whether caused by negligence, accident, or any other reason.
3. Parent/Guardian Responsibility
If the Participant is a minor, the parent/guardian:
- Acknowledges they have reviewed the risks with the child.
- Accepts full responsibility for the child’s actions and safety.
- Agrees to supervise the child and guild their actions.
4. Safe Use of Materials
The Participant agrees to:
- Follow all posted rules and staff instructions.
- Use art materials and tools responsibly.
- Not intentionally misuse or damage property.
5. Indemnification
The Participant agrees to indemnify and hold harmless the Clubhouse from any claims resulting from their (or their child’s) actions, including third-party claims.

**I HAVE READ AND UNDERSTAND THIS AGREEMENT. I VOLUNTARILY ACCEPT ALL RISKS AND WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.**
