WAIVER AND RELEASE OF LIABILITY — READ BEFORE SIGNING
In consideration of the risk of injury while participating in guided fly fishing activities, including but not limited to wade fishing, float trips, casting instruction, and related outdoor activities (the “Activity”), and as consideration for the right to participate in the Activity and its related events and activities, I, ______________________________ (Name of Participant), the undersigned, acknowledge and agree that:

1. Assumption of Risk
I understand that the risk of injury from the activities involved in the Activity is significant, including the potential for serious injury, permanent disability, paralysis, or death. While particular skills, equipment, and personal discipline may reduce these risks, the risk of serious injury does exist.

2. Assumption of Risk Including Negligence
I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of the released parties or others, and I assume full responsibility for my participation.

3. Compliance and Hazard Awareness
I willingly agree to comply with the stated and customary terms and conditions for participation. If I observe any unusual or significant hazard during my presence or participation, I will immediately remove myself from participation and bring such hazard to the attention of Angler’s Choice Fly Fishing / Andrew Milliorn (the “Company”).

4. Release, Indemnification, and Hold Harmless
I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS Angler’s Choice Fly Fishing, Andrew Milliorn, their owners, officers, employees, contractors, agents, guides, affiliates, landowners, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the Activity (collectively, the “Releasees”) FROM ANY AND ALL CLAIMS, demands, causes of action, injuries, disability, death, or loss or damage to person or property associated with my participation, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by Texas law.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I certify that I am the parent or legal guardian of the minor participant named above. I consent to the minor’s participation and agree to the release provided above. For myself, my child, and our heirs, assigns, and next of kin, I RELEASE, INDEMNIFY, AND HOLD HARMLESS the Releasees from any and all liabilities incident to the minor’s participation, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
